interest vehicle that was manufactured prior to thirty years of
the current year, and allows hoods, door handles, and bumpers to

                   A  BILL  FOR  AN  ACT

RELATING TO MOTOR VEHICLES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 286-2, Hawaii Revised Statutes, is
 
 2 amended by amending the definition of "special interest vehicle"
 
 3 to read as follows:
 
 4      ""Special interest vehicle" means a vehicle of any age that,
 
 5 because of its significance, is being collected, preserved,
 
 6 restored, or maintained by a collector.  The term includes a
 
 7 street rod vehicle and a street rod replica vehicle, as those
 
 8 terms are defined in section 286-26.5; a vehicle manufactured
 
 9 before 1949; [and] a vehicle manufactured after 1948 to resemble
 
10 a vehicle manufactured before 1949[.]; and any special interest
 
11 vehicle manufactured prior to thirty years of the current year."
 
12      SECTION 2.  Section 286-26.5, Hawaii Revised Statutes, is
 
13 amended as follows:
 
14      1.  By amending subsection (a) to read:
 
15      "(a)  As used in this section:
 
16      "Collector" means an owner of one or more vehicles,
 
17 including parts vehicles, who collects, purchases, acquires,
 
18 trades, or disposes of a vehicle or its parts, for the owner's
 
19 own use, to preserve, restore, and maintain the vehicle or

 1 another vehicle for hobby or historical purposes.
 
 2      "Parts vehicle" means a vehicle that is owned by a collector
 
 3 to furnish parts for the restoration or maintenance of a special
 
 4 interest vehicle.
 
 5      "Street rod replica vehicle" means a vehicle that was
 
 6 assembled from a manufactured kit, either as:
 
 7      (1)  A complete kit to construct a new vehicle consisting of
 
 8           a prefabricated body and chassis;
 
 9      (2)  Components manufactured before 1949; or
 
10      (3)  Components manufactured after 1948 to resemble a
 
11           vehicle manufactured before 1949;
 
12 and that has been modified in its body style or design through
 
13 the use of nonoriginal or reproduction components, such as the
 
14 frame, engine, drive train, suspension, or brakes, in a manner
 
15 that does not adversely affect its safe performance as a motor
 
16 vehicle or render the vehicle unlawful for use on public
 
17 highways.
 
18      "Street rod vehicle" means a vehicle that was:
 
19      (1)  Manufactured before 1949; [or]
 
20      (2)  Manufactured after 1948 to resemble a vehicle
 
21           manufactured before 1949; or
 
22      (3)  Manufactured prior to thirty years of the current year;

 1 and that has been modified in its body style or design through
 
 2 the use of nonoriginal or reproduction components, such as the
 
 3 frame, engine, drive train, suspension, or brakes, in a manner
 
 4 that does not adversely affect its safe performance as a motor
 
 5 vehicle or render the vehicle unlawful for use on public
 
 6 highways.  The term does not include a motorcycle, an antique
 
 7 vehicle, or a [restored] reconstructed vehicle."
 
 8      2.  By amending subsections (c) and (d) as follows:
 
 9      "(c)  A state vehicle identification number shall be issued
 
10 to a street rod vehicle that was manufactured after 1948 to
 
11 resemble a vehicle manufactured before 1949, or prior to thirty
 
12 years of the current year, when no vehicle identification number
 
13 is present on the vehicle; when more than one vehicle
 
14 identification number is present on the vehicle; or when the
 
15 vehicle identification number is absent from the body or frame,
 
16 or both, of the vehicle.  The state vehicle identification number
 
17 shall be assigned by the director of finance of the county in
 
18 which the vehicle resides.
 
19      To obtain a state vehicle identification number under this
 
20 subsection, the owner of a street rod vehicle that was
 
21 manufactured after 1948 to resemble a vehicle manufactured before
 
22 1949 or prior to thirty years of the current year, shall provide:

 1      (1)  A title of ownership from the previous owner of the
 
 2           vehicle's body or frame;
 
 3      (2)  A bill of sale or invoices for all major parts used in
 
 4           the modification of the vehicle; and
 
 5      (3)  A weight certificate issued by a state-certified scale
 
 6           for the actual weight of the vehicle.
 
 7      (d)  Notwithstanding any other law to the contrary:
 
 8      (1)  Street rod vehicles and street rod replica vehicles
 
 9           shall be equipped with the following equipment:
 
10           (A)  Hydraulic service brakes on all wheels;
 
11           (B)  Sealed beam or halogen headlights;
 
12           (C)  Turn signals and a turn signaling switch;
 
13           (D)  Safety glass or lexan windshield;
 
14           (E)  Electric or vacuum windshield wiper located in
 
15                front of the driver;
 
16           (F)  Standard or DOT/SAE-approved tail lights; and
 
17           (G)  A parking brake that operates on at least two
 
18                wheels on the same axle;
 
19      (2)  Street rod vehicles and street rod replica vehicles
 
20           shall be equipped in such a manner that no part of a
 
21           vehicle, other than the vehicle's tires, will make
 
22           contact with the surface of a flat highway when the

 1           vehicle is operated on the same;
 
 2      (3)  Seatbelts, bumpers, hoods, door handles, and fenders
 
 3           shall be optional equipment on street rod vehicles and
 
 4           street rod replica vehicles; [and]
 
 5      (4)  Seatbelts, bumpers, hoods, door handles, and fenders
 
 6           shall be optional equipment on vehicles manufactured
 
 7           before 1949, and on vehicles manufactured after 1948 to
 
 8           resemble a vehicle manufactured before 1949[.]; and
 
 9      (5)  Hoods, door handles, and bumpers shall be optional
 
10           equipment on vehicles manufactured prior to thirty
 
11           years of the current year.
 
12      In the event of a conflict between this subsection and
 
13 equipment requirements specified in chapters 286, 291 and 291C,
 
14 this subsection shall control."
 
15      SECTION 3.  Statutory material to be repealed is bracketed.
 
16 New statutory material is underscored.
 
17      SECTION 4.  This Act shall take effect upon its approval.
