REPORT TITLE:
Parking Citations


DESCRIPTION:
Expands to 60 days the time within which a rental or U-drive
lessor has to provide the court with the name and address of a
lessee receiving a parking citation.  Deletes waiver of this

                   A  BILL  FOR  AN  ACT

RELATING TO PARKING CITATIONS. 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 291C-168.5, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "[[]§291C-168.5[]]  Liability of lessee for parking
 
 4 citation.  Notwithstanding any other law to the contrary, if the
 
 5 registered owner of record is the lessor of a rental or U-drive
 
 6 motor vehicle, as defined in section 286-2 pursuant to a written
 
 7 lease agreement, the lessee at the time of the issuance of the
 
 8 parking citation shall be responsible for such summons or
 
 9 citation; provided[, however, said] that the lessor shall be
 
10 responsible for such summons or citation if the lessor does not
 
11 provide the court having jurisdiction over the summons or
 
12 citation the name and address of the lessee within [forty-five]
 
13 sixty days after a notice containing the date, time, and location
 
14 of the violation and the license number of the vehicle is sent to
 
15 the lessor[; provided further that the administrative judge of
 
16 the court having jurisdiction over the citation or summons may
 
17 waive the requirement of providing the name and address of the
 
18 lessee by the lessor and impose an administrative fee of five
 
19 dollars per citation on the lessor]."
