REPORT TITLE:
Thrill Craft; Regulation


DESCRIPTION:
Prohibits the creation of a wake or speeds in excess of 5 mph by
thrill craft in the "no wake zone", defined as the area extending
seaward 1,200 feet from the shoreline.  Phases out the launching,
mooring, or operation of all carbureted 2-stroke engine powered

                   A  BILL  FOR  AN  ACT

RELATING TO OCEAN RECREATION AND COASTAL AREAS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 200, Hawaii Revised Statutes, is amended
 
 2 by adding two new sections to part II to be appropriately
 
 3 designated and to read as follows:
 
 4      "§200-    Thrill craft; no wake zone.  Except as may be
 
 5 necessary for the protection of public health and safety, the
 
 6 creation of a wake or speeds in excess of five miles per hour by
 
 7 thrill craft in the no wake zone shall be prohibited.
 
 8      §200-    Prohibition of carbureted two-stroke engine powered
 
 9 thrill craft.  (a)  Commencing August 1, 2000, the launching,
 
10 mooring, or operation of all carbureted two-stroke engine powered
 
11 thrill craft within the ocean waters is prohibited, except:
 
12      (1)  Any two-stroke engine powered thrill craft whose fuel
 
13           is directly injected into the cylinder shall be exempt
 
14           from the prohibition;
 
15      (2)  Any thrill craft powered by a two-stroke engine whose
 
16           fuel is injected into the crankcase prior to entering
 
17           the cylinder, and in which fuel injection engine was
 
18           purchased before July 1, 2000, shall be prohibited
 
19           commencing October 1, 2002.  For the purpose of this

 1           paragraph, purchase shall include a contract of
 
 2           purchase by the owner or dealer entered into before
 
 3           July 1, 2000;
 
 4      (3)  Any thrill craft powered by a two-stroke engine whose
 
 5           engine is certified as meeting the United States
 
 6           Environmental Protection Agency No. 2006 standard or
 
 7           the CARB 2001 standard shall be exempt from this
 
 8           prohibition;
 
 9      (4)  Sailboats utilizing two-stroke engines as auxiliary
 
10           power shall be prohibited commencing October 1, 2002;
 
11      (5)  Any thrill craft powered by a two-stroke engine rated
 
12           at ten horsepower or less shall be prohibited
 
13           commencing October 1, 2002; or
 
14      (6)  Any thrill craft powered by an engine that has been
 
15           certified as meeting the United States Environmental
 
16           Protection Agency's 2001-2005 emission standard shall
 
17           be prohibited commencing October 1, 2002."
 
18      SECTION 2.  Section 200-23, Hawaii Revised Statutes, is
 
19 amended by adding two new definitions to be appropriately
 
20 inserted and to read as follows:
 
21      ""No wake zone" means the area extending seaward one
 
22 thousand two hundred feet from the shoreline.
 
23      "Shoreline" has the same meaning as defined in section

 2      SECTION 3.  New statutory material is underscored.
 
 3      SECTION 4.  This Act shall take effect on July 1, 2000.
