                   A  BILL  FOR  AN  ACT


RELATING TO CONSERVATION.


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 193, Hawaii Revised Statutes, is amended
 
 2 by adding a new part to be appropriately designated and to read
 
 3 as follows:
 
 4                "PART   . YOUTH CONSERVATION CORPS
 
 5      §193-    Authorization.  The governor is authorized to avail
 
 6 the State of the benefits of any law or laws of the United
 
 7 States, now existing or to be enacted, such as title 16 United
 
 8 States Code, sections 1701 to 1706, or any other law or laws of
 
 9 similar purport.
 
10      §193-  Administration.  To carry out the program
 
11 authorized by this part, the governor may:
 
12      (1)  Enter into an agreement or agreements, or designate the
 
13           department of land and natural resources, or any other
 
14           department or departments of the state government as
 
15           the state agency or state agencies to enter into an
 
16           agreement or agreements, with the proper authorities of
 
17           the United States;
 
18      (2)  Designate the department of land and natural resources,
 
19           or any department or departments of the state

 1           government to design programs to provide healthful
 
 2           outdoor training and employment for young persons and
 
 3           to advance the conservation, development, and
 
 4           management of natural resources and recreational areas,
 
 5           in accordance with the applicable federal law.  The
 
 6           designated department or departments may also adopt
 
 7           appropriate rules under chapter 91 to carry out the
 
 8           programs so designed; and
 
 9      (3)  Defray one-half of all costs incurred with respect to
 
10           the programs or any other proportion of the costs of
 
11           the programs, which may be required by the applicable
 
12           laws of the United States, out of any moneys
 
13           appropriated to the department or departments
 
14           designated to participate in the programs, without
 
15           regard to the original purpose of the appropriations.
 
16      §193-  Personnel laws; applicability.  The provisions of
 
17 chapters 76 to 80, and 88, except provisions of state law
 
18 relating to the application of the Social Security Act of the
 
19 United States to the extent that the Act shall be applicable
 
20 under the federal law establishing the youth programs, shall not
 
21 apply to persons employed under this part."
 
22      SECTION 2.  Section 247-7, Hawaii Revised Statutes, is
 
23 amended to read as follows:

 1      "§247-7 Disposition of taxes.  All taxes collected under
 
 2 this chapter shall be paid into the state treasury to the credit
 
 3 of the general fund of the State, to be used and expended for the
 
 4 purposes for which the general fund was created and exists by
 
 5 law; provided that of the taxes collected each fiscal year,
 
 6 twelve and one-half per cent shall be paid into the rental
 
 7 housing trust fund established by section 201G-432 and twenty-
 
 8 five per cent shall be paid into the natural area reserve fund
 
 9 established by section 195-9; provided that the funds paid into
 
10 the natural area reserve fund shall be annually disbursed to the
 
11 natural area partnership [and] program, the forest stewardship
 
12 [programs] program, and the youth conservation corps established
 
13 under chapter 193, by the department of land and natural
 
14 resources after joint consultation with the forest stewardship
 
15 committee and the natural area reserves system commission."
 
16      SECTION 3.  Section 247-7, Hawaii Revised Statutes, is
 
17 amended by to read as follows:
 
18      "§247-7 Disposition of taxes.  All taxes collected under

21 purposes for which the general fund was created and exists by

 1 fund established by section 201G-432 and twenty-five per cent
 
 2 shall be paid into the natural area reserve fund established by
 
 3 section 195-9; provided that the funds paid into the natural area
 
 4 reserve fund shall be annually disbursed to the natural area
 
 5 partnership [and] program, the forest stewardship [programs]
 
 6 program, and the youth conservation corps established under
 
 7 chapter 193, by the department of land and natural resources
 
 8 after joint consultation with the forest stewardship committee
 
 9 and the natural area reserves system commission."
 
10      SECTION 4.  There is appropriated out of the natural area
 
11 reserve fund the sum of $          , or so much thereof as may be
 
12 necessary for fiscal year 2000-2001, for the youth conservation
 
13 corps created by this Act.  The sum appropriated shall be
 
14 expended by the department of land and natural resources for the
 
15 purposes of this Act.
 
16      SECTION 5.  Statutory material to be repealed is bracketed.
 
17 New statutory material is underscored.
 
18      SECTION 6.  This Act shall take effect on July 1, 2000;
 
19 provided that section 3 of this Act shall take effect on July 1,
 
20 2001.
