                   A  BILL  FOR  AN  ACT

RELATING TO THE DUPLICATION OF GOVERNMENTAL SERVICES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Act 223, Session Laws of Hawaii 1998, Relating
 
 2 to the Duplication of Government Services, requested the governor
 
 3 and mayors of the respective counties to submit:
 
 4      (1)  A report of the findings and recommendations on
 
 5           eliminating duplication of all government services at
 
 6           the state and county levels with respect to highway and
 
 7           parks services to the legislature not later than
 
 8           November 30, 1998; and
 
 9      (2)  A final report, including the final plan, on
 
10           eliminating duplication of all government services at
 
11           the state and county levels not later than November 30,
 
12           1999.
 
13      A Preliminary Report on Highway and Roadway Maintenance and
 
14 Parks Programs, dated January 1999, and a Phase Two report that
 
15 addressed additional areas, dated November 20, 1999, have been
 
16 submitted to the legislature.
 
17      The legislature finds that these two reports address areas
 
18 of duplication, as well as some of the possible options either to
 
19 reduce duplication, or to declare duplication acceptable.  These

 1 two reports did not propose legislation to eliminate the
 
 2 duplication of services, as required by Act 223.
 
 3      The legislature recognizes the difficulties associated with
 
 4 the consolidation or elimination of duplicative services.
 
 5 However, the legislature finds that action must be taken if
 
 6 government resources are to be utilized in the most efficient
 
 7 manner possible, while preserving critical services relating to
 
 8 highways, public and private roads, parks, aging, animal control,
 
 9 civil defense system, child support, housing, land use
 
10 regulations, lands, split ownership of public schools, veterans
 
11 burial, wastewater, and youth, whether provided by the State or
 
12 counties.
 
13      The purpose of this Act is to require the governor and the
 
14 mayors of the respective counties to finalize implementation
 
15 plans to eliminate duplicative services and develop an
 
16 implementation timetable by November 2000.
 
17      SECTION 2.  The governor and the mayors of the respective
 
18 counties, by November 2000, shall:
 
19      (1)  Finalize implementation plans to eliminate duplicative
 
20           state and county services; and
 
21      (2)  Develop a timetable to eliminate the duplication of
 
22           services by:
 
23           (A)  Agreement between the respective providers of

 1                services; or
 
 2           (B)  Implementation of a managed competition process to
 
 3                select a provider of the services.
 
 4      SECTION 3.  The governor and the mayors of the respective
 
 5 counties shall report to the legislature twenty days prior to the
 
 6 legislative sessions of 2001, 2002, and 2003 on the progress of
 
 7 implementation plans, including but not limited to:
 
 8      (1)  Savings realized;
 
 9      (2)  Levels of services affected; and
 
10      (3)  Any additional problems, or issues encountered as the
 
11           result of the consolidation or elimination of
 
12           duplicative state and county services.
 
13      SECTION 4.  This Act shall take effect upon its approval.
