                   A  BILL  FOR  AN  ACT

RELATING TO PUBLIC SCHOOL FACILITIES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The purpose of this Act is to require all newly
 
 2 constructed school buildings and all existing school buildings
 
 3 undergoing roof repair to install insulation with a minimum heat
 
 4 transfer resistance value of R-19, or to conform to the
 
 5 applicable provisions of the Hawaii Model Energy Code, 1993,
 
 6 regarding roof heat gain, at the time of their construction or
 
 7 repair.
 
 8      Insulating the roofs of school buildings at the time of
 
 9 their construction or repair is an example of improving
 
10 government efficiency.  R-19 insulation lowers interior
 
11 temperatures by eight degrees or more on hot days, which
 
12 generally means that a building's occupants can enjoy the local
 
13 weather without air conditioning.  Insulation costs about as much
 
14 as purchasing and installing an air conditioning system.  While
 
15 air conditioning doubles or triples electricity costs and incurs
 
16 ongoing maintenance costs, insulation is a one-time expense.
 
17      Insulating the roofs of school buildings that already
 
18 utilize air conditioning would allow smaller units to be used and
 
19 reduce the building's air conditioning load.  Limiting the effect

 1 of this Act to times when roofing crews and their equipment are
 
 2 already on site will reduce labor costs and minimize the
 
 3 inconvenience to students and faculty.  The need for insulation
 
 4 or other heat barriers can be reduced by utilizing light-colored
 
 5 or medium-colored roofing material, which tend to reflect more
 
 6 radiant heat than dark-colored roofing material.
 
 7      SECTION 2.  Section 302A-1501, Hawaii Revised Statutes, is
 
 8 amended to read as follows:
 
 9      "[[]§302A-1501[]]  Noise and climate control at school
 
10 facilities.(a)  The department shall plan for, and request
 
11 appropriations necessary to implement, acoustic noise control and
 
12 air conditioning of existing and new school facilities in areas
 
13 that are susceptible to extremes of temperature or affected by
 
14 aircraft, traffic, and other noise.  The department shall develop
 
15 appropriate standards and consider local conditions for deciding
 
16 whether acoustic noise control and air conditioning of existing
 
17 and new school facilities are required for effective classroom
 
18 instruction.  In all cases where acoustic treatment of school
 
19 facilities is planned, the department shall utilize the services
 
20 of individuals qualified by training and experience to recommend
 
21 appropriate noise control procedures and components.  Acoustic
 
22 noise control and air conditioning shall be given equal weight as
 
23 all other factors in the criteria used by the department in

 1 setting priorities for school construction and renovations.
 
 2      (b)  In any case where air conditioners are installed in a
 
 3 particular school, the department may require that the
 
 4 approximate cost of electricity and maintenance for air
 
 5 conditioners not installed by the department of accounting and
 
 6 general services be paid by a private entity until the department
 
 7 establishes temperature and noise standards and a policy relating
 
 8 to air conditioning.
 
 9      (c)  All newly constructed school buildings and all existing
 
10 school buildings undergoing roof repair shall install insulation
 
11 with a minimum heat transfer resistance value of R-19, or conform
 
12 to the applicable provisions of the Hawaii Model Energy Code,
 
13 1993, regarding roof heat gain, at the time of their construction
 
14 or repair.  For the purposes of this subsection, "R-value or heat

16 transfer resistance value" equals (m )(K/W), where:  "m " is the
 
17 area of the material (of a specified thickness) in square meters;
 
18 "K" is the temperature difference across the material in degrees
 
19 Kelvin; and "W" is the amount of heat flowing across the material
 
20 in watts."
 
21      SECTION 3.  There is appropriated out of the general
 
22 revenues of the State of Hawaii the sum of $900,000, or so much
 
23 thereof as may be necessary for fiscal year 2000-2001, to install
 
24 insulation with a minimum heat transfer resistance value of R-19

 1 in all newly constructed school buildings and all existing school
 
 2 buildings undergoing roof repair, at the time of their
 
 3 construction or repair.
 
 4      SECTION 4.  The sum appropriated shall be expended by the
 
 5 department of accounting and general services for the purposes of
 
 6 this Act.
 
 7      SECTION 5.  Statutory material to be repealed is bracketed.
 
 8 New statutory material is underscored.
 
 9      SECTION 6.  This Act shall take effect on July 1, 2000.
