REPORT TITLE:
Animal Quarantine; User Fees


DESCRIPTION:
Reduces the user fee of the animal quarantine station by an
unspecified percentage of the user fee rate that existed on
January 1, 2000.  Prohibits the department of agriculture from
repaying from the animal quarantine special fund to the general
fund, any of the $600,000 that was initially deposited from the
general fund to the animal quarantine special fund.  Appropriates
funds from the general fund for deposit into the animal

                   A  BILL  FOR  AN  ACT

RELATING TO AGRICULTURE AND ANIMALS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature declares that keeping Hawaii
 
 2 rabies-free is a public health and safety concern, and that the
 
 3 cost of animal quarantine should be borne by all the people of
 
 4 Hawaii and not only those people who are required to use the
 
 5 services and facilities of the animal quarantine station.
 
 6      The purpose of this Act is to:
 
 7      (1)  Reduce the user fee of the animal quarantine station by
 
 8           a certain percentage of the user fee rate that existed
 
 9           on January 1, 2000;
 
10      (2)  Not require the repayment from the animal quarantine
 
11           special fund to the general fund, any of the $600,000
 
12           that was initially deposited from the general fund to
 
13           the animal quarantine special fund; and
 
14      (3)  Appropriate funds from the general fund into the animal
 
15           quarantine special fund.
 
16      SECTION 2.  Section 142-98, Hawaii Revised Statutes, is
 
17 amended by amending subsection (a) to read as follows:
 
18      "(a)  The department of agriculture may establish and assess
 
19 fees pursuant to chapter 91 for facilities usage, vaccination
 
20 programs, emergency transportation of quarantined animals,

 1 insecticides, medication, and other goods and services deemed
 
 2 necessary and provided by the department of agriculture in
 
 3 enforcing the provisions of this chapter; provided that the
 
 4 assessment of these fees does not violate any other provision of
 
 5 this chapter.  The user fee shall be reduced by       per cent of
 
 6 the user fee rate that existed on January 1, 2000."
 
 7      SECTION 3.  The department of agriculture shall not be
 
 8 required to repay from the animal quarantine special fund to the
 
 9 general fund, any of the $600,000 that was initially deposited
 
10 from the general fund to the animal quarantine special fund.
 
11      SECTION 4.  There is appropriated out of the general
 
12 revenues of the State of Hawaii the sum of $1 or so much thereof
 
13 as may be necessary for fiscal year 2000-2001 for deposit into
 
14 the animal quarantine special fund.
 
15      The sum appropriated shall be expended by the department of
 
16 agriculture for the purposes of this Act.
 
17      SECTION 5.  New statutory material is underscored.
 
18      SECTION 6.  This Act shall take effect on July 1, 2000.
