                   A  BILL  FOR  AN  ACT

RELATING TO MOTOR VEHICLES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 249-9.3, Hawaii Revised Statutes, is
 
 2 amended by amending subsection (a) to read as follows:
 
 3      "(a)  In lieu of the number plates contracted on behalf of
 
 4 the counties by the director of finance of the city and county of
 
 5 Honolulu, the county directors of finance shall issue special
 
 6 number plates to any organization in the State that meets the
 
 7 minimum standards and qualifications established under this
 
 8 section.  Organizations are authorized to retain the fees
 
 9 collected, less expenses, for the special number plates.
 
10      The director of finance of the city and county of Honolulu,
 
11 in consultation with the directors of finance of the counties of
 
12 Kauai, Maui, and Hawaii, shall establish special design
 
13 parameters and restrictions for decals or graphic representations
 
14 affixable to special number plates; provided that the decal shall
 
15 not be larger than [two and one-half] three inches wide by three
 
16 inches high."
 
17      SECTION 2.  Section 249-9.3, Hawaii Revised Statutes, is
 
18 amended by amending subsection (b) to read as follows:
 
19      "(b)  For the purposes of this section, the following terms

 1 shall have the following meanings:
 
 2      "Director" unless indicated otherwise by its context, means
 
 3 the county directors of finance.
 
 4      "Organization" means [an]:
 
 5      (1)  An organization of at least one hundred members in good
 
 6           standing that is:
 
 7     [(1)] (A)  A not-for-profit organization recognized as such
 
 8                by the Internal Revenue Service and whose primary
 
 9                purpose is to provide the community with specific
 
10                programs to improve the public's health,
 
11                education, or general welfare; or 
 
12     [(2)] (B)  A military service veterans group; [or 
 
13      (3)] (2)  A state or county agency approved by the
 
14           director[.
 
15      Any organization includes any]; or
 
16      (3)  Any school or accredited institution of higher learning
 
17           or a college or recognized program thereof.
 
18      "Special number plate" means a license plate with a decal on
 
19 its face that represents an organization as defined in this
 
20 section."
 
21      SECTION 3.  Section 249-9.3, Hawaii Revised Statutes, is
 
22 amended by amending subsection (d) to read as follows:
 
23      "(d)  An organization shall apply for a special number plate

 1 with the director on an application form prescribed by the
 
 2 director.  The application shall include:
 
 3      (1)  A design of the organization's decal;
 
 4      (2)  A signed notarized statement by an officer or director
 
 5           of the organization that the organization will acquire
 
 6           at least one hundred fifty special number plates; and
 
 7      (3)  The dollar amount the organization plans to raise from
 
 8           each special number plate.
 
 9      The director shall determine, based on criteria in this
 
10 section, and the director's discretion, whether an organization's
 
11 application has been accepted or rejected.  The director shall
 
12 also seek the approval of an organization's decal design from the
 
13 county chief of police where the application is made.
 
14      If the director rejects an application, the director shall
 
15 state the reasons for the rejection in writing and shall allow
 
16 the applicant to reapply within a reasonable period after the
 
17 rejection.
 
18      After an organization's application has been approved,
 
19 [members of the organization] a motor vehicle owner may apply for
 
20 the organization's special number plate.  The director may
 
21 require [proof of membership of an organization's members in
 
22 addition to] the completion of a form as prescribed by the
 
23 director.  Special number plates shall be issued only to the

 1 registered owner of an applicant motor vehicle."                 
 
 2      SECTION 4.  Statutory material to be repealed is bracketed.
 
 3 New statutory material is underscored.
 
 4      SECTION 5.  This Act shall take effect upon its approval.
