estate brokers and salespersons.  Changes requirement to 5 hours
each year instead of 10 hours every 2 years.  Authorizes real

                   A  BILL  FOR  AN  ACT

RELATING TO REAL ESTATE BROKERS AND SALESPERSONS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 467-11.5, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "§467-11.5  Prerequisites for license renewal.(a)  Prior
 
 4 to the license renewal of a real estate broker or real estate
 
 5 salesperson, the licensee shall provide the commission with proof
 
 6 of having attended [ten] five hours of continuing education or
 
 7 its equivalent as determined by the commission [during] for each
 
 8 year of the two-year period preceding the application for
 
 9 renewal.  The commission shall have the authority to set
 
10 requirements for continuing education courses, determine whether
 
11 courses meet those requirements, and assign the number of
 
12 continuing education hours to those courses.  Failure to satisfy
 
13 the continuing education requirement by the license expiration
 
14 date shall result in the license being automatically placed on an
 
15 "inactive" status.
 
16      (b)  To reactivate a license which has been placed on an
 
17 "inactive" status, the licensee shall submit to the commission
 
18 proof of having satisfied the continuing education requirement of
 
19 this section, a complete application setting forth the

 1 information as may be prescribed or required by the commission,
 
 2 and payment of the proper fee.
 
 3      (c)  Courses offered by alternative delivery methods with
 
 4 interactive instructional techniques may be approved by the
 
 5 commission.  Interactive instructional techniques may include but
 
 6 are not limited to:
 
 7      (1)  The opportunity for immediate exchange with an
 
 8           instructor; and
 
 9      (2)  Assessment and remediation through the assistance of
 
10           computer, electronic, audio, or audiovisual interactive
 
11           instruction designed to internally measure and evaluate
 
12           whether students have mastered stated learning
 
13           objectives.
 
14      (d)  No license shall be renewed if the license trade name,
 
15 partnership, or corporation is not currently registered with the
 
16 department of commerce and consumer affairs.
 
17      (e)  The commission shall have the further authority to
 
18 develop its own continuing education courses or approve courses
 
19 developed elsewhere."
 
20      SECTION 2.  Statutory material to be repealed is bracketed.
