REPORT TITLE:
Conditionally Approved Animals


DESCRIPTION:
Requires a permit for the importation of a conditionally approved
animal into the State to be granted by the DOA not more than 3
working days after the DOA receives a complete application for
the permit, including any fees.  Adds 34 insect species to the

                   A  BILL  FOR  AN  ACT

RELATING TO PLANT AND NON-DOMESTIC ANIMAL QUARANTINE.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 150A-6, Hawaii Revised Statutes, is
 
 2 amended by amending subsection (b) to read as follows:
 
 3      "(b)  The board shall maintain:
 
 4      (1)  A list of conditionally approved animals that require a
 
 5           permit for import into the State;
 
 6      (2)  A list of restricted animals that require a permit for
 
 7           both import into the State and possession; and
 
 8      (3)  A list of animals that are prohibited entry into the
 
 9           State;
 
10 provided that the board shall adopt rules, pursuant to chapter
 
11 91, to establish an ad hoc panel of no fewer than three members
 
12 with applicable expertise in vertebrate biology to identify
 
13 whether an animal is a prohibited hybrid animal when the
 
14 department suspects that the lineage of the animal is not as
 
15 stated by the owner or on other official documents.
 
16      Animals on the lists of conditionally approved and
 
17 restricted animals shall be imported only by permit.  Any animal
 
18 that is not on the lists of conditionally approved, restricted,
 
19 or prohibited animals shall be prohibited until the board's

 1 review and determination for placement on one of these lists;
 
 2 provided that the department may issue a special permit on a
 
 3 case-by-case basis for the importation and possession of an
 
 4 animal that is not on the lists of prohibited, restricted, or
 
 5 conditionally approved animals, for the purpose of remediating
 
 6 medical emergencies or agricultural or ecological disasters, or
 
 7 conducting medical or scientific research in a manner that the
 
 8 animal will not be detrimental to agriculture, the environment,
 
 9 or humans if the importer of the animal can meet permit
 
10 requirements as determined by the board; and provided further
 
11 that the department may issue a short-term special permit on a
 
12 case-by-case basis not to exceed ninety days for the importation
 
13 and possession of an animal that is not on the list of
 
14 prohibited, restricted, or conditionally approved animals for the
 
15 purpose of filming, performance, or exhibition if the importer of
 
16 the animal can meet permit and bonding requirements as determined
 
17 by the board.
 
18      A permit for the importation of a conditionally approved
 
19 animal into the State shall be granted by the department not more
 
20 than three working days after the department receives a complete
 
21 application for the permit, including any fees assessed pursuant
 
22 to section 150A-7.5."
 
23      SECTION 2.  Notwithstanding chapter 91, Hawaii Revised

 1 Statutes, and section 150A-6(e), Hawaii Revised Statutes, to the
 
 2 contrary, the following animals are designated as conditionally
 
 3 approved animals and are added to the list of conditionally
 
 4 approved animals for the purposes of section 150A-6, Hawaii
 
 5 Revised Statutes, and the rules of the department of agriculture:
 
 6      (1)  Chilorcus circumdatus;
 
 7      (2)  Chilorcus baileyii;
 
 8      (3)  Lindorus lophante;
 
 9      (4)  Rhyzobius lophante;
 
10      (5)  Crytolaemus montrouziera;
 
11      (6)  Coleomegilla maculata;
 
12      (7)  Tenodera aridifolia sinensis;
 
13      (8)  Leptomastix dactylopii;
 
14      (9)  Nasonia vitripennis;
 
15     (10)  Muscidifurax zaraptor;
 
16     (11)  Chysoperla rufilabris;
 
17     (12)  Scolothrips sexmaculatus;
 
18     (13)  Aphidius colemani;
 
19     (14)  Aphidoletes aphidomyza;
 
20     (15)  Geocoris punctipes;
 
21     (16)  Heterohabditis megidis;
 
22     (17)  Steinernema feltiae;

17      The department of agriculture shall formally incorporate the
 
18 foregoing animals added by this Act into the department's rules
 
19 as expeditiously as possible.
 
20      SECTION 3.  New statutory material is underscored.
 
21      SECTION 4.  This Act shall take effect upon its approval.
