DESCRIPTION:
Establishes a department of education repair and maintenance
special fund into which .5% of new capital improvement
appropriations shall be transferred.  Requires the fund be used
solely for DOE repair and maintenance projects or school
beautification projects.  Reduces the works of art special fund's

                   A  BILL  FOR  AN  ACT

RELATING TO REPAIR AND MAINTENANCE. 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 103, Hawaii Revised Statutes, is amended
 
 2 by adding a new section to be appropriately designated and to
 
 3 read as follows:
 
 4      "§103-     Department of education repair and maintenance
 
 5 special fund.  (a)  There is created a department of education
 
 6 repair and maintenance special fund, into which shall be
 
 7 transferred one-half of one per cent of all state fund
 
 8 appropriations for capital improvements designated for the
 
 9 construction cost element; provided that this transfer shall
 
10 apply only to capital improvement appropriations that are
 
11 designated for the construction or renovation of state buildings.
 
12      (b)  The repair and maintenance special fund shall be used
 
13 solely for school repair and maintenance projects provided under
 
14 sections 302A-1504 and 302A-1505 which may include school
 
15 beautification projects.
 
16      (c)  The one-half of one per cent amount, which is included
 
17 in all capital improvement appropriations, shall be calculated at
 
18 the time the appropriation bills are signed into law.  The moneys
 
19 shall be transferred into the repair and maintenance special fund

 1 upon availability of moneys from the appropriations.  Each agency
 
 2 receiving capital improvement appropriations shall calculate the
 
 3 one-half of one per cent and transfer the moneys into the repair
 
 4 and maintenance special fund.
 
 5      (d)  Expenditures from the repair and maintenance special
 
 6 fund shall be made by the comptroller.
 
 7      (e)  The comptroller shall:
 
 8      (1)  Provide each agency receiving capital improvement
 
 9           appropriations with information regarding items that
 
10           shall be included and excluded from the one-half of one
 
11           per cent amount;
 
12      (2)  Ensure that each agency calculates its one-half of one
 
13           per cent amount correctly; and
 
14      (3)  Ensure that each agency transfers the correct amount to
 
15           the repair and maintenance special fund in a timely
 
16           manner.
 
17      (f)  The comptroller and the board of education shall track
 
18 amounts due from each agency under the one-half of one per cent
 
19 requirement as provided in this section."
 
20      SECTION 2.  Section 103-8.5, Hawaii Revised Statutes, is
 
21 amended as follows:
 
22      1.   Subsection (a) is amended to read as follows:
 
23      "(a)  There is created a works of art special fund, into

 7      2.   Subsection (c) is amended to read as follows:

11 shall be transferred into the works of art special fund upon
 
12 availability of moneys from the appropriations.  Each agency
 
13 receiving capital improvement appropriations shall calculate the
 
14 one-half of one per cent amount and transfer the moneys into the
 
15 works of art special fund."
 
16      3.   Subsections (e) and (f) are amended to read as follows:
 
17      "(e)  The comptroller shall:
 
18      (1)  Provide each agency receiving capital improvement
 
19           appropriations with information regarding items that
 
20           shall be included and excluded from the one-half of one
 
21           per cent amount;
 
22      (2)  Ensure that each agency calculates its one-half of one

 4 amounts due from each agency under the one-half of one per cent
 
 5 requirement as provided in this section."
 
 6      SECTION 3.  Statutory material to be repealed is bracketed.
 
 7 New statutory material is underscored.
 
 8      SECTION 4.  This Act shall take effect upon its approval.
