Motor Vehicle Inspection; PMVI


DESCRIPTION:
Eliminates the annual motor vehicle inspection (safety check)
requirement for all vehicles except ambulances; trucks, truck-
tractors, semitrailers, and pole trailers having a gross vehicle
weight rating of more than 10,000 pounds; buses; rental or U-

                   A  BILL  FOR  AN  ACT

RELATING TO PERIODIC MOTOR VEHICLE INSPECTION.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 286-25, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "§286-25  Operation of a vehicle without a certificate of
 
 4 inspection.  Whoever operates, permits the operation of, causes
 
 5 to be operated, or parks any vehicle on a public highway without
 
 6 a [current] valid official certificate of inspection[, issued
 
 7 under] required by section 286-26, shall be fined not more than
 
 8 $100."
 
 9      SECTION 2.  Section 286-26, Hawaii Revised Statutes, is
 
10 amended by amending subsection (b) to read as follows:
 
11      "(b)  All other vehicles, including motorcycles, trailers,
 
12 semitrailers, and pole trailers having a gross vehicle weight
 
13 rating of 10,000 pounds or less, and antique motor vehicles as
 
14 defined in section 249-1[, except those in subsections (c) and
 
15 (d), shall be certified as provided in subsection (e) every
 
16 twelve months.] shall be certified as provided in subsection (e),
 
17 section 286-21, and section 286-22."
 
18      SECTION 3.  Section 286-26, Hawaii Revised Statutes, is
 
19 amended by amending subsection (d) to read as follows:

 1      "(d)  Every vehicle shall be certified prior to the
 
 2 [issuance of a temporary or permanent registration by the
 
 3 director of finance and prior to the] transfer of any
 
 4 registration[;] by the director of finance; provided that this
 
 5 requirement shall not apply to a subsequent transfer of
 
 6 registration in a vehicle that carries a current certificate of
 
 7 inspection."
 
 8      SECTION 4.  Statutory material to be repealed is bracketed.
 
 9 New statutory material is underscored.
 
10      SECTION 5.  This Act shall take effect upon its approval.
