                     A BILL FOR AN ACT

RELATING TO CORRECTIONS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Within the limits of money appropriated, the
 
 2 director of public safety may provide model programs for female
 
 3 offenders that respond to statewide needs and geographical areas
 
 4 and may award grants for the programs.  The programs may:
 
 5      (1)  Provide a comprehensive continuum of care that
 
 6           addresses gender specific needs;
 
 7      (2)  Respond in a rehabilitative way to the type of offenses
 
 8           female offenders generally commit, addressing pathways
 
 9           to crime;
 
10      (3)  Respond to the problems of female offenders with
 
11           dependent children;
 
12      (4)  Respond to the importance of developing independent
 
13           living skills;
 
14      (5)  Assist female offenders to overcome their own extreme
 
15           degree of dependency, learning strong and healthy
 
16           relationships without losing self-esteem; and
 
17      (6)  Prepare to offer technical assistance and training
 
18           toward the implementation of other similar programs. 
 
19      SECTION 2.  The director of public safety may appoint an
 
20 advisory council on the adult and juvenile female offenders in

 1 correctional facilities.  The advisory council shall have a
 
 2 maximum of twenty members, including the executive director of
 
 3 the office of youth services, and shall reflect a statewide
 
 4 geographical representation.  The advisory council shall
 
 5 continue until it is terminated by the director of public safety.
 
 6      The advisory council may:
 
 7      (1)  Develop a plan to increase interagency cooperation to
 
 8           address the needs unique to female offenders;
 
 9      (2)  Recommend programming needs to the department of public
 
10           safety and the office of youth services; and
 
11      (3)  Identify other issues related to the appropriate
 
12           programming of the adult and juvenile female offender.
 
13      SECTION 3.  To assist the advisory council to develop a plan
 
14 to increase interagency cooperation and identify programming and
 
15 other needs of the adult and juvenile female offender, the
 
16 director of public safety may make a planning grant available
 
17 from funds appropriated by the legislature specifically for that
 
18 purpose.
 
19      SECTION 4.  The director of public safety may:
 
20      (1)  Review all plans for programs for female offenders;
 
21      (2)  Review planning proposals from the advisory council and
 
22           award planning grants;

 1      (3)  Appoint the members of the advisory council created
 
 2           under this Act and provide staff and other
 
 3           administrative services to the advisory council; and
 
 4      (4)  Monitor the planning grant expenditures of the advisory
 
 5           council.
 
 6      SECTION 5.  The director of public safety may collaborate
 
 7 with the departments of human services, health, labor and
 
 8 industrial relations, and education, as well as with
 
 9 representatives of the private sector, to develop a comprehensive
 
10 continuum of care to address the gender-specific needs of female
 
11 offenders.
 
12      SECTION 6.  There is appropriated out of the general
 
13 revenues of the State of Hawaii the sum of $1 or so much thereof
 
14 as may be necessary for fiscal year 2000-2001 to carry out the
 
15 purposes of this Act.
 
16      The sum appropriated shall be expended by the department of
 
17 public safety.
 
18      SECTION 7.  This Act shall take effect upon its approval,
 
19 except that section 6 shall take effect on July 1, 2000.
