                   A  BILL  FOR  AN  ACT

RELATING TO SALARY PERIODS. 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that in the best interest
 
 2 of the State and its employees, a uniform payroll system will
 
 3 help make government more efficient.  Therefore, the purpose of
 
 4 this Act is to implement where possible, a uniform payroll
 
 5 system.
 
 6      SECTION 2.  Section 78-13, Hawaii Revised Statutes, is
 
 7 amended to read as follows:
 
 8      "§78-13  Salary periods.  (a)  Unless otherwise provided by
 
 9 law, all officers and employees shall be paid at least
 
10 semimonthly except that substitute teachers, part-time hourly
 
11 rated teachers of adult and evening classes, and other part-
 
12 time, intermittent, or casual employees may be paid once a month
 
13 and that the governor, upon reasonable notice and upon
 
14 determination that the payroll payment basis should be converted
 
15 from predicted payroll to after-the-fact payroll, may allow a
 
16 one-time once a month payroll payment to all public officers and
 
17 employees to effect a conversion to after-the-fact payroll as
 
18 follows:
 
19      (1)  The implementation of the after-the-fact payroll will

 1           commence with the June 30, 1998, pay day, which will be
 
 2           delayed to July 1, 1998;
 
 3      (2)  The July 15, 1998, pay day will be delayed to July 17,
 
 4           1998;
 
 5      (3)  The July 31, 1998, pay day will be delayed to August 3,
 
 6           1998;
 
 7      (4)  The August 14, 1998, pay day will be delayed to
 
 8           August 19, 1998;
 
 9      (5)  The August 31, 1998, pay day will be delayed to
 
10           September 4, 1998;
 
11      (6)  The September 15, 1998, pay day will be delayed to
 
12           September 18, 1998; and
 
13      (7)  Thereafter, pay days will be on the fifth and the
 
14           twentieth of every month.  If the fifth and the
 
15           twentieth fall on a state holiday, Saturday, or Sunday,
 
16           the pay day will be the immediately preceding weekday.
 
17      The implementation of the after-the-fact payroll shall not
 
18 be subject to negotiation under chapter 89.
 
19      [(b)  If an employee has been working for the State for at
 
20 least six months, has no paid leave accumulated, and has an
 
21 existing salary overpayment balance:
 
22      (1)  The employee may be paid the employee's salary on the
 
23           same pay dates and for the same pay periods as non-

 1           salaried employees.
 
 2      (2)  Upon accumulation of eighty hours of paid leave, the
 
 3           employee shall be paid the employee's salary on the
 
 4           same pay dates and for the same pay periods as salaried
 
 5           employees.
 
 6      (c)  If an employee has been working for the State for at
 
 7 least six months and has had at least two incidents of leave
 
 8 which results in salary overpayment within the past six months:
 
 9      (1)  The employee may be paid the employee's salary on the
 
10           same pay dates and for the same pay period as non-
 
11           salaried employees.
 
12      (2)  If there are no incidents of leave which result in
 
13           salary overpayment for a subsequent four-month period,
 
14           the employee shall be paid the employee's salary on the
 
15           same pay dates and for the same pay periods as salaried
 
16           employees.
 
17      (d)  The implementation of subsections (b) and (c) shall not
 
18 be subject to negotiation under chapter 89.
 
19      (e)] (b)  All employees, except those belonging to
 
20 bargaining units 5 and 7, hired on or after July 1, 1998, shall
 
21 be paid on [the same pay dates and for the same pay periods as
 
22 non-salaried employees.]:
 
23      (1)  The fifth of every month for the pay period from the

 1           sixteenth to the last day of the month; and
 
 2      (2)  The twentieth of every month for the pay period from
 
 3           the first to the fifteenth of the month."
 
 4      SECTION 3.  Statutory material to be repealed is bracketed.
 
 5 New statutory material is underscored.
 
 6      SECTION 4.  This Act shall take effect upon its approval.
