                   A  BILL  FOR  AN  ACT

RELATING TO BODY PIERCING. 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 709, Hawaii Revised Statutes, is amended
 
 2 by adding a new section to be appropriately designated and to
 
 3 read as follows:
 
 4      "§709-     Unlawful body piercing of a minor.  (1)  As used
 
 5 in this section:
 
 6      "Body piercing" means the perforation of human tissue, other
 
 7 than an ear, for a nonmedical purpose.
 
 8      "Minor" means a person under the age of eighteen who:
 
 9      (a)  Is not married; and
 
10      (b)  Has not been declared emancipated by a court of law.
 
11      (2)  It shall be unlawful for a person to perform body
 
12 piercing on a minor unless the person obtains the prior written
 
13 informed consent of the minor's parent or legal guardian.  The
 
14 minor's parent or legal guardian shall execute the written
 
15 informed consent in the presence of the person performing the
 
16 body piercing on the minor, or in the presence of an employee or
 
17 agent of the person.
 
18      (3)  It shall be unlawful for a person to misrepresent the
 
19 person's self as a parent or legal guardian of a minor for the

 1 purpose of providing written informed consent for the body
 
 2 piercing of the minor.
 
 3      (4)  Any person who violates subsection (2) or (3) is guilty
 
 4 of a misdemeanor and shall be fined not more than $500 for the
 
 5 first offense.  Any subsequent offenses shall subject the person
 
 6 to a fine not less than $500 nor more than $1,000." 
 
 7      SECTION 2.  New statutory material is underscored.
 
 8      SECTION 3.  This Act shall take effect upon its approval.
