                   A  BILL  FOR  AN  ACT

RELATING TO SCHOOL RECORDS.


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 663, Hawaii Revised Statutes, is amended
 
 2 by adding a new section to be appropriately designated and to
 
 3 read as follows:
 
 4      "§663-    Disclosure of school records; detriment to morals
 
 5 or discipline; no liability.  No public or private school, grade
 
 6 kindergarten through twelve, shall receive any child who has
 
 7 attended another public or private school, unless the parent or
 
 8 guardian of the child produces to the public or private school to
 
 9 be entered, a certificate of release for disclosure of all
 
10 previous public or private school records, as applicable.  This
 
11 certificate of release shall be signed by the parent or guardian
 
12 and shall waive the right to sue the public or private school
 
13 that provided information about the child.  If the parent or
 
14 guardian refuses to sign the release, the public or private
 
15 school providing the information shall be exempt from liability,
 
16 when in good faith, the public or private school provides
 
17 information regarding any action of the child that is a detriment
 
18 to the morals or discipline of any public or private school."
 
19      SECTION 2.  New statutory material is underscored.
