                   A  BILL  FOR  AN  ACT

RELATING TO EDUCATION.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1                       Part 1.  Introduction
 
 2      SECTION 1.  This Act shall be known, and may be cited as, as
 
 3 the Student Bill of 1999.
 
 4      SECTION 2.  The legislature finds that the Hawaii state
 
 5 student council serves as a student organization that focuses its
 
 6 energy on enhancing the school environment.  The council acts as
 
 7 a bridge between students and the department of education, the
 
 8 board of education, and the legislature.  The guidelines for
 
 9 student representation and participation, adopted by the board of
 
10 education on July 20, 1972, state that the functions of the
 
11 council are to:
 
12      (1)  Schedule regular meetings for the discussion of student
 
13           issues and concerns;
 
14      (2)  Recommend and advise courses of action to the
 
15           department of education;
 
16      (3)  Maintain communication with the board of education; and
 
17      (4)  Communicate all deliberations and activities to all
 
18           district and school student councils.
 
19      The legislature also finds that chapter 317, Hawaii Revised

 1 Statutes, provides for the establishment of an annual conference
 
 2 of secondary school students (grades seven to twelve), to enable
 
 3 students in Hawaii's secondary schools to identify, discuss, and
 
 4 arrive at recommended solutions to major youth problems, with
 
 5 emphasis on school problems that require the attention and joint
 
 6 action by the students, the department of education, and the
 
 7 legislature.
 
 8      The recommendations of the Hawaii state student council and
 
 9 Hawaii state student conference form the basis for the
 
10 initiatives contained in parts 2 to 11 of this Act.
 
11                    Part 2.  Teacher Evaluation
 
12      SECTION 3.  There is appropriated out of the general
 
13 revenues of the State of Hawaii the sum of $        , or so much
 
14 thereof as may be necessary for fiscal year 1999-2000, and the
 
15 sum of $        , or so much thereof as may be necessary for
 
16 fiscal year 2000-2001, for the development and implementation of
 
17 a teacher evaluation program that allows school administrators,
 
18 parents, teachers, and students to assess teacher effectiveness
 
19 in promoting student success and school improvement, and assures
 
20 the public that only effective teachers continue in the
 
21 classroom; provided that the department of education shall:
 
22      (1)  Work with the Hawaii state teachers association, the
 
23           Hawaii state student council, and the Hawaii state

 1           parents, teachers, and students association in the
 
 2           development and implementation of the teacher
 
 3           evaluation program; and
 
 4      (2)  Work with the Hawaii state teachers association
 
 5           develop an action plan that provides a smooth
 
 6           transition from PATH (program for assessing teaching in
 
 7           Hawaii)--the existing teacher evaluation program--to
 
 8           the new evaluation program.
 
 9                    Part 3.  School Facilities
 
10      SECTION 4.  There is appropriated out of the general
 
11 revenues of the State of Hawaii the sum of $        , or so much
 
12 thereof as may be necessary for fiscal year 1999-2000, and the
 
13 same sum, or so much thereof as may be necessary for fiscal year
 
14 2000-2001, to enable school custodians in the department of
 
15 education, with respect to student lavatories, to:
 
16      (1)  Daily:
 
17           (A)  Clean toilets, urinals, basins, shelves, and
 
18                hardware with cleaner-disinfectant solution;
 
19           (B)  Spot clean mirrors, partitions, walls, and
 
20                stainless steel and chrome surfaces;
 
21           (C)  Sweep and mop floors using cleaner-disinfectant
 
22                solution;
 
23           (D)  Remove standing water from floors;

 1           (E)  Empty waste receptacles; and
 
 2           (F)  Resupply toilet paper, towels, napkins, and soap
 
 3                as needed;
 
 4      (2)  At least once a week:
 
 5           (A)  Remove stains and buildup from toilets, basins,
 
 6                urinals, fixtures, and floors;
 
 7           (B)  Scrub or foam down floors and walls using
 
 8                disinfectant solution;
 
 9           (C)  Spot clean glass in doors and partitions, walls,
 
10                doors and ledges, etc., as needed;
 
11           (D)  Spray buff accessible areas of resilient floors to
 
12                remove scuffs and marks;
 
13           (E)  Clean light fixtures;
 
14           (F)  Strip, clean, and apply wax to resilient floors;
 
15           (G)  Replace burned out lights as needed;
 
16           (H)  Spot clean floors as needed because of accidents;
 
17           (I)  Clean and polish furniture;
 
18           (J)  Dust window ledges, sills, furniture, bookcases,
 
19                etc.; and
 
20      (3)  Clean windows at least once a year.
 
21                      Part 4.  Safety Office
 
22      SECTION 5.  Chapter 302A, Hawaii Revised Statutes, is
 
23 amended by adding a new section to be appropriately designated

 1 and to read as follows:
 
 2      "§302A-     Departmental safety office.  There is
 
 3 established within the office of the superintendent a safety
 
 4 office, which shall develop and ensure compliance with all
 
 5 requirements and standards relating to workplace, employee, and
 
 6 student safety and health; hazardous materials management; campus
 
 7 security; fire safety; and the coordination of safety and health
 
 8 training programs."
 
 9      SECTION 6.  There is appropriated out of the general
 
10 revenues of the State of Hawaii the sum of $        , or so much
 
11 thereof as may be necessary for fiscal year 1999-2000, and the
 
12 sum of $        , or so much thereof as may be necessary for
 
13 fiscal year 2000-2001, to provide five additional permanent,
 
14 full-time equivalent (5.00 FTE), professional staff positions;
 
15 and one additional permanent, full-time equivalent (1.00 FTE),
 
16 clerical staff position, including other current expenses and
 
17 equipment, to carry out the purposes of section 5.
 
18                Part 5.  College/Career Counselors
 
19      SECTION 7.  There is appropriated out of the general
 
20 revenues of the State of Hawaii the sum of $        , or so much
 
21 thereof as may be necessary for fiscal year 1999-2000, and the
 
22 sum of $        , or so much thereof as may be necessary for
 
23 fiscal year 2000-2001, to provide one permanent, full-time

 1 equivalent (1.00 FTE), college/career counselor position in each
 
 2 high school for every three hundred students, for the purpose of:
 
 3      (1)  Assisting these students in planning, preparing, and
 
 4           obtaining financial aid for college; or
 
 5      (2)  Assisting these students with the transition from high
 
 6           school to the workforce.
 
 7                 Part 6.  School Improvement Plans
 
 8      SECTION 8.  Section 302A-1004, Hawaii Revised Statutes, is
 
 9 amended to read as follows:
 
10      "[[]§302A-1004[]]  Educational assessment and
 
11 accountability; annual reports.(a)  The department shall submit
 
12 to the legislature and to the governor, at least twenty days
 
13 prior to the convening of each regular legislative session, an
 
14 educational status report that includes but is not limited to the
 
15 following:
 
16      (1)  Results of school-by-school assessments of educational
 
17           outcomes, including reference to such student
 
18           performance standards and school-by-school assessment
 
19           models as may be developed by the commission on
 
20           performance standards and adopted by the board;
 
21      (2)  Summaries of school improvement plans;
 
22      (3)  Summary descriptions of the demographic makeup of the
 
23           schools, with indications of the range of these

 1           conditions among schools within Hawaii;
 
 2      (4)  Comparisons of conditions affecting Hawaii's schools
 
 3           with the conditions of schools in other states; and
 
 4      (5)  Other such assessments as may be deemed appropriate by
 
 5           the board.
 
 6      (b)  The department shall provide electronic access to
 
 7 computer-based financial management, student information, and
 
 8 other information systems to the legislature and the auditor.
 
 9 The auditor shall submit to the legislature and the governor, at
 
10 least twenty days prior to the convening of each legislative
 
11 session, a fiscal accountability report that includes but is not
 
12 limited to the following:
 
13      (1)  The financial analysis of expenditures by the
 
14           department with respect to the following areas:
 
15           (A)  Administration;
 
16           (B)  Facilities and operations;
 
17           (C)  Teacher support and development;
 
18           (D)  Pupil support;
 
19           (E)  Instructional support; and
 
20           (F)  Classroom instruction; and
 
21      (2)  The measures of accuracy, efficiency, and productivity
 
22           of the department, districts, and schools in delivering
 
23           resources to the classroom and the student.

 1      (c)  The school improvement plans described in subsection
 
 2 (a)(2) shall be developed with input from a minimum of three
 
 3 student-body representatives."
 
 4                Part 7.  School Security Attendants
 
 5      SECTION 9.  Chapter 302A, Hawaii Revised Statutes, is
 
 6 amended by adding a new section to be appropriately designated
 
 7 and to read as follows:
 
 8      "§302A-     Training of school security attendants.  Subject
 
 9 to the availability of funding, the initial and ongoing training
 
10 of school security attendants shall be carried out by the
 
11 department of public safety after June 30, 2000; provided that
 
12 the department of education shall remain responsible for the
 
13 management and supervision of school security attendants."
 
14      SECTION 10.  Section 26-14.6, Hawaii Revised Statutes, is
 
15 amended to read as follows:
 
16      "§26-14.6  Department of public safety.(a)  The department
 
17 of public safety shall be headed by a single executive to be
 
18 known as the director of public safety.
 
19      (b)  The department of public safety shall be responsible
 
20 for the formulation and implementation of state policies and
 
21 objectives for correctional, security, law enforcement, and
 
22 public safety programs and functions, for the administration and
 
23 maintenance of all public or private correctional facilities and

 1 services, for the service of process, and for the security of
 
 2 state buildings.
 
 3      (c)  Effective July 1, 1990, the Hawaii paroling authority
 
 4 and the crime victim compensation commission are placed within
 
 5 the department of public safety for administrative purposes only.
 
 6      (d)  Effective July 1, 1990, the functions and authority
 
 7 heretofore exercised by:
 
 8      (1)  The department of corrections relating to adult
 
 9           corrections and the intake service centers;
 
10      (2)  The judiciary relating to the sheriff's office and
 
11           judiciary security personnel; and
 
12      (3)  The department of the attorney general relating to
 
13           state law enforcement officers and narcotics
 
14           enforcement investigators with the narcotics
 
15           enforcement division,
 
16 shall be transferred to the department of public safety.
 
17      (e)  Effective July 1, 1990, the functions and authority
 
18 heretofore exercised by the department of health pursuant to
 
19 chapters 329 and 329C, with the exception of sections 329-2,
 
20 329-3, and 329-4(3) to (8), shall be transferred to the
 
21 department of public safety.
 
22      (f)  Effective July 1, 1990, the functions, authority, and
 
23 obligations, together with the limitations imposed thereon and

 1 the privileges and immunities conferred thereby, exercised by a
 
 2 "sheriff", "sheriffs", a "sheriff's deputy", "sheriff's
 
 3 deputies", a "deputy sheriff", "deputy sheriffs", or a "deputy",
 
 4 under sections 21-8, 47-18, 88-51, 105-4, 134-11, 134-51,
 
 5 183D-11, 187A-14, 201G-55, 201G-74, 231-25, 281-108, 281-111,
 
 6 286-52, 286-52.5, 321-1, 322-6, 325-9, 325-80, 353-11, 383-71,
 
 7 438-5, 445-37, 482E-4, 485-6, 501-42, 501-171, 501-218, 521-78,
 
 8 578-4, 584-6, 587-33, 603-29, 604-6.2, 606-14, 607-2, 607-4,
 
 9 607-8, 633-8, 634-11, 634-12, 634-21, 634-22, 651-33, 651-37,
 
10 651-51, 654-2, 655-2, 657-13, 660-16, 666-11, 666-21, 803-23,
 
11 803-34, 803-35, 804-14, 804-18, 804-41, 805-1, 806-71, and 832-23
 
12 shall be exercised to the same extent by the department of public
 
13 safety.
 
14      (g)  Effective January 1, 1993, the functions and authority
 
15 heretofore exercised by the attorney general and the department
 
16 of the attorney general relating to the executive security
 
17 officers shall be transferred to the department of public safety.
 
18      (h)  Effective January 1, 1993, the functions and authority
 
19 heretofore exercised by the superintendent of education and the
 
20 department of education relating to after hours security
 
21 contracts at its facilities, including the security functions
 
22 being performed by employees of the public library system as well
 
23 as the contractual security services for the libraries, shall be

 1 transferred to the department of public safety.
 
 2      (i)  Effective January 1, 1993, the functions and authority
 
 3 heretofore exercised by the director of health and the department
 
 4 of health relating to uniformed security employees and security
 
 5 contracts at various state hospitals throughout the State shall
 
 6 be transferred to the department of public safety.
 
 7      (j)  Effective January 1, 1993, the functions and authority
 
 8 heretofore exercised by the director of human services and the
 
 9 department of human services relating to contractual security
 
10 guard services shall be transferred to the department of public
 
11 safety.
 
12      (k)  Effective July 1, 1994, the functions and authority
 
13 heretofore exercised by the adjutant general relating to security
 
14 for national guard and state civil defense facilities in the
 
15 Diamond Head complex, for after work hours, shall be transferred
 
16 to the department of public safety.
 
17      (l)  Effective July 1, 2000, the functions and authority
 
18 heretofore exercised by the superintendent of education and the
 
19 department of education relating to the initial and ongoing
 
20 training of school security attendants shall be transferred to
 
21 the department of public safety; provided that:
 
22      (1)  The training of school security attendants by the
 
23           department of public safety shall be subject to the

 1           availability of funding; and
 
 2      (2)  The department of education shall remain responsible
 
 3           for the management and supervision of school security
 
 4           attendants."
 
 5      SECTION 11.  There is appropriated out of the general
 
 6 revenues of the State of Hawaii the sum of $        , or so much
 
 7 thereof as may be necessary for fiscal year 1999-2000, and the
 
 8 sum of $        , or so much thereof as may be necessary for
 
 9 fiscal year 2000-2001, to provide one permanent, full-time
 
10 equivalent (1.00 FTE), school security attendant position in each
 
11 middle, intermediate, and high school for every four hundred
 
12 students, with a minimum of two permanent, full-time equivalent
 
13 (2.00 FTE), attendant positions per school.
 
14      SECTION 12.  There is appropriated out of the general
 
15 revenues of the State of Hawaii the sum of $        , or so much
 
16 thereof as may be necessary for fiscal year 1999-2000, and the
 
17 sum of $        , or so much thereof as may be necessary for
 
18 fiscal year 2000-2001, to provide initial and ongoing training
 
19 for school security attendants throughout the State.  The sums
 
20 appropriated by this section shall be expended by the department
 
21 of public safety.
 
22                    Part 8.  Athletic Equipment
 
23      SECTION 13.  There is appropriated out of the general

 1 revenues of the State of Hawaii the sum of $        , or so much
 
 2 thereof as may be necessary for fiscal year 1999-2000, and the
 
 3 sum of $        , or so much thereof as may be necessary for
 
 4 fiscal year 2000-2001, to replace, repair, or upgrade worn,
 
 5 unsafe, obsolete, or unsanitary athletic equipment.
 
 6     Part 9.  Computers, Educational Materials, and Furniture
 
 7      SECTION 14.  There is appropriated out of the general
 
 8 revenues of the State of Hawaii the sum of $        , or so much
 
 9 thereof as may be necessary for fiscal year 1999-2000, and the
 
10 sum of $        , or so much thereof as may be necessary for
 
11 fiscal year 2000-2001, to purchase additional computer hardware
 
12 and software for the classroom to meet the department of
 
13 education's standard of one computer for every six students.
 
14      SECTION 15.  There is appropriated out of the general
 
15 revenues of the State of Hawaii the sum of $        , or so much
 
16 thereof as may be necessary for fiscal year 1999-2000, and the
 
17 sum of $        , or so much thereof as may be necessary for
 
18 fiscal year 2000-2001, to provide each middle, intermediate, and
 
19 high school with:
 
20      (1)  The personnel resources needed to operate a computer
 
21           laboratory that is open before and after school; and
 
22      (2)  The program resources needed to upgrade and update
 
23           hardware and software for the computer laboratory

 1           described in paragraph (1).
 
 2      SECTION 16.  There is appropriated out of the general
 
 3 revenues of the State of Hawaii the sum of $        , or so much
 
 4 thereof as may be necessary for fiscal year 1999-2000, and the
 
 5 sum of $        , or so much thereof as may be necessary for
 
 6 fiscal year 2000-2001, to replace lost, destroyed, or obsolete;
 
 7 to repair damaged; to update outdated; and to purchase
 
 8 sufficient, educational materials for middle, intermediate, and
 
 9 high schools.
 
10      SECTION 17.  There is appropriated out of the general
 
11 revenues of the State of Hawaii the sum of $        , or so much
 
12 thereof as may be necessary for fiscal year 1999-2000, and the
 
13 sum of $        , or so much thereof as may be necessary for
 
14 fiscal year 2000-2001, to replace lost, destroyed, or obsolete;
 
15 to repair damaged; to update outdated; and to purchase
 
16 sufficient, classroom furniture for middle, intermediate, and
 
17 high schools.
 
18                       Part 10.  Curriculum
 
19      SECTION 18.  The board of education shall adopt such
 
20 policies as may be necessary to require all high school students
 
21 to pass a one semester class in basic computer science or to pass
 
22 a computer literacy equivalency examination equaling one-half
 
23 Carnegie unit, for graduation.

 1      SECTION 19.  The board of education shall adopt such
 
 2 policies as may be necessary to require all high schools to offer
 
 3 at least three advanced placement courses, the subjects of which
 
 4 shall be decided by each school according to the current and
 
 5 future interests of its students.
 
 6                 Part 11.  Co-curricular Concerns
 
 7      SECTION 20.  There is appropriated out of the general
 
 8 revenues of the State of Hawaii the sum of $        , or so much
 
 9 thereof as may be necessary for fiscal year 1999-2000, and the
 
10 sum of $        , or so much thereof as may be necessary for
 
11 fiscal year 2000-2001, to provide one permanent, full-time
 
12 equivalent (1.00 FTE), student activities coordinator position at
 
13 each high school.
 
14                   Part 12.  General Provisions
 
15      SECTION 21.  Unless otherwise provided, the sums
 
16 appropriated shall be expended by the department of education for
 
17 the purposes of this Act.
 
18      SECTION 22.  Statutory material to be repealed is bracketed.
 
19 New statutory material is underscored.
 
20      SECTION 23.  This Act shall take effect on July 1, 1999.
