                   A  BILL  FOR  AN  ACT

RELATING TO HUNTING AND TOURISM. 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature recognizes that Hawaii holds a
 
 2 unique position as a tourist destination of world-wide
 
 3 reputation, yet needs to expand its economic and tourism base and
 
 4 could do so by taking advantage of the hunting possibilities
 
 5 available in Hawaii twelve months of the year.  Further, by
 
 6 allowing foreign visitors to hunt on private land, the
 
 7 legislature recognizes that hunter visits, or combined
 
 8 hunting/tourism visits of hunters and their families, would
 
 9 provide numerous benefits for guides, suppliers of goods and
 
10 services, landowners, the general public, and for the enhanced
 
11 management of game animals and game birds by the department of
 
12 land and natural resources.
 
13      The purpose of this Act is to establish a system whereby
 
14 foreign hunters, who cannot meet the criteria for a regular
 
15 hunting license as developed in the United States and Canada
 
16 where hunter education programs are established and available,
 
17 can nonetheless hunt in Hawaii on private land, with a Hawaii-
 
18 licensed guide.
 
19      SECTION 2.  Chapter 183D is amended by adding a new section
 
20 to be appropriately designated and to read as follows:

 1      "§183D-    Application and issuance of limited-use hunting
 
 2 permits; fees.  (a)  For the purpose of allowing foreign hunters
 
 3 to come to Hawaii and hunt game birds or game mammals on private
 
 4 lands, pursuant to sections 183D-26, 183D-34, and 183D-51, and to
 
 5 allow for the inability of many foreign hunters to meet the
 
 6 criteria for a regular hunting license due to the lack of a
 
 7 hunter education program in their area or country of citizenship,
 
 8 the department shall establish a system of limited-use hunting
 
 9 permits.
 
10      (b)  Limited-use hunting permits shall be valid:
 
11      (1)  Only on private land;
 
12      (2)  Only in the physical presence of a Hawaii-licensed
 
13           hunting guide who has successfully completed a course
 
14           or program of hunter education and safety as described
 
15           in section 183D-28(b)(2), and possesses a valid Hawaii
 
16           hunting license;
 
17      (3)  For game bird hunting, pursuant to rules adopted for
 
18           regular hunting licenses or permits for private and
 
19           commercial bird shooting preserves; and
 
20      (4)  For game mammal hunting.
 
21      (c)  A limited-use hunting permit shall be issued by the
 
22 department or its authorized agent to a foreign hunter or, for
 
23 expediency, to the foreign hunter's Hawaii-licensed guide upon
 
24 presentation of:

 1      (1)  A written application in the form prescribed by the
 
 2           department; provided that if the application is
 
 3           completed by a Hawaii-licensed guide, a written
 
 4           statement from the foreign hunter authorizing the guide
 
 5           to act as the foreign hunter's agent in acquiring the
 
 6           permit shall be required;
 
 7      (2)  A visa, passport, or similar suitable identification,
 
 8           or a legible copy thereof, showing that the foreign
 
 9           hunter does not reside in a state of the United States,
 
10           Canadian province, or other territories, provinces,
 
11           states, or countries that provide, with reasonable
 
12           accessibility, hunter education;
 
13      (3)  The applicant's name, address, territory, province,
 
14           state or country of residence, age, race, height,
 
15           weight, and color of hair and eyes; and
 
16      (4)  Payment of the limited-use permit fee or any other
 
17           hunting related fee the board may require as provided
 
18           in this chapter.
 
19      (d)  The department shall assess the following fees:
 
20      (1)  For game mammals, section 183D-10.5 to the contrary
 
21           notwithstanding, the limited-use permit fee shall be a
 
22           combination of an amount equal to Hawaii's current
 
23           nonresident hunting license fee; provided that this

 1           portion of the fee shall be placed in the wildlife
 
 2           revolving fund; plus a twenty-five per cent surcharge;
 
 3           provided that this portion of the fee shall be placed
 
 4           in a separate fund used only to benefit and enhance
 
 5           Hawaii's hunting and game habitat programs on public
 
 6           lands; and
 
 7      (2)  For game birds, the limited-use permit fee shall be
 
 8           equal to the fee for a regular hunting permit for
 
 9           private and commercial bird shooting preserves.
 
10      (e)  The expiration, duplication, and display of limited-use
 
11 hunting permits shall be the same as for regular hunting licenses
 
12 pursuant to sections 183D-23 to 183D-25, except as provided in
 
13 subsection (b)(5)."
 
14      SECTION 3.  Section 183D-12, Hawaii Revised Statutes, is
 
15 amended to read as follows:
 
16      "§183D-21  Hunting licenses and limited-use hunting permits
 
17 required.  No person shall hunt, pursue, kill, or take any game
 
18 bird or mammal without first procuring a hunting license[;] or
 
19 limited-use hunting permit; provided that section 183D-32 to the
 
20 contrary notwithstanding, no license shall be required of persons
 
21 who may be authorized in writing by the board to destroy game
 
22 birds or game mammals injurious to forest growth or agriculture,
 
23 or that constitute a nuisance or a health hazard."

 1      SECTION 4.  Statutory material to be repealed is bracketed.
 
 2 New statutory material is underscored.
 
 3      SECTION 5.  This Act shall take effect upon its approval.
