                   A  BILL  FOR  AN  ACT

RELATING TO MOTORIZED VEHICLES IN FOREST RESERVES AND
   CONSERVATION DISTRICTS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION  1.  Section 183-19, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "§183-19  Exclusion [of livestock] from forest reserves,
 
 4 game management areas, public hunting areas, and natural area
 
 5 reserves; notice.  (a)  Livestock.  When branded wild cattle or
 
 6 horses are found on any forest land, game management area, public
 
 7 hunting area, or natural area reserve in the State, which land is
 
 8 duly set apart and established as a forest reserve, game
 
 9 management area, public hunting area, or natural area reserve, or
 
10 if the land is privately owned and surrendered as defined in
 
11 section 183-15, the department, in all cases where the land is so
 
12 set apart and established as a forest reserve, game management
 
13 area, public hunting area, or natural area reserve, whether from
 
14 privately owned lands or public lands, may remove, shoot, or
 
15 destroy the cattle or horses without compensation to the owner,
 
16 after thirty days' public notice of the intended action in the
 
17 county where the cattle or horses are found.
 
18      (b)  Motorized vehicles.  The use of motorized vehicles on
 
19 lands under the jurisdiction of this chapter is prohibited.  For

 1 the purposes of this section, "motorized vehicle" includes
 
 2 passenger automobiles, trucks of any type including sport utility
 
 3 vehicles, all-terrain-vehicles, motorcycles, or any other vehicle
 
 4 that is not propelled by human power.  This subsection shall not
 
 5 apply to any motorized vehicle operated by a federal, state, or
 
 6 county employee on official business or any person operating a
 
 7 motorized vehicle with permission from the department."
 
 8      SECTION 2.  Section 183C-4, Hawaii Revised Statutes, is
 
 9 amended by amending subsection (d) to read as follows:
 
10      "(d)  The department shall establish zones within the
 
11 conservation district, which shall be restricted to certain uses.
 
12 The department, by rules, may specify the land uses permitted
 
13 therein which may include, but are not limited to, farming,
 
14 flower gardening, operation of nurseries or orchards, growth of
 
15 commercial timber, grazing, recreational or hunting pursuits, or
 
16 residential use.
 
17      The rules shall not permit the use of motorized vehicles on
 
18 lands under the jurisdiction of this chapter.  For the purposes
 
19 of this subsection, "motorized vehicle" includes passenger
 
20 automobiles, trucks of any type including sports utility
 
21 vehicles, all-terrain-vehicles, motorcycles, or any other vehicle
 
22 that is not propelled by human power.  This subsection shall not

 1 apply to any motorized vehicle operated by a federal, state, or
 
 2 county employee on official business or any person operating a
 
 3 motorized vehicle with permission from the department.
 
 4      The rules may control the extent, manner, and times of the
 
 5 uses, and may specifically prohibit unlimited cutting of forest
 
 6 growth, soil mining, or other activities detrimental to good
 
 7 conservation practices."
 
 8      SECTION 3.  Statutory material to be repealed is bracketed.
 
 9 New statutory material is underscored.
 
10      SECTION 4.  This Act shall take effect upon its approval.
