DESCRIPTION:
Allows issuance of special license plates for those civilians
providing service to the United States, on Oahu, or offshore at a
distance of not more than three miles at the time of the December

                   A  BILL  FOR  AN  ACT

RELATING TO LICENSE PLATES.


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 249-9.2 , Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "§249-9.2  Special number plates; military service.(a)  In
 
 4 lieu of the number plates contracted on behalf of the counties by
 
 5 the director of finance of the city and county of Honolulu, the
 
 6 director of finance shall provide for a fee, one set of special
 
 7 number plates upon the receipt of an application together with:
 
 8      (1)  Specific proof that the applicant was awarded the
 
 9           Purple Heart by the United States Department of Defense
 
10           for wounds received in military or naval combat against
 
11           an armed enemy of the United States;
 
12      (2)  Certification that the applicant is a veteran;
 
13      (3)  Specific proof that the applicant was providing
 
14           military service, whether in the military or as a
 
15           civilian, to the United States, on Oahu, or offshore at
 
16           a distance of not more than three miles at the time of
 
17           the December 7, 1941, attack on Pearl Harbor.
 
18           Certification from the Hawaii state chairperson of the
 
19           Pearl Harbor Survivors Association shall constitute
 
20           sufficient proof;

 1      (4)  Specific proof that the applicant was confined as a
 
 2           prisoner of war while providing military service to the
 
 3           United States; or
 
 4      (5)  Certification from the United States Department of
 
 5           Veterans Affairs or the state office of veterans'
 
 6           services that the applicant is a combat veteran or a
 
 7           veteran of the Vietnam conflict or the Korean conflict
 
 8           or World War II.
 
 9      (b)  The design of the plates for:
 
10      (1)  Purple heart recipients shall include the words "COMBAT
 
11           WOUNDED";
 
12      (2)  Veterans shall include the word "VETERAN";
 
13      (3)  Pearl Harbor survivors shall include the words "PEARL
 
14           HARBOR SURVIVOR";
 
15      (4)  Former prisoners of war shall include the words "FORMER
 
16           PRISONER OF WAR";
 
17      (5)  Combat veterans shall include the words "COMBAT
 
18           VETERAN";
 
19      (6)  Veterans of the Vietnam conflict shall include the
 
20           words "VIETNAM VETERAN";
 
21      (7)  Veterans of the Korean conflict shall include the words
 
22           "KOREA VETERAN"; and
 
23      (8)  Veterans of World War II shall include the words "WORLD

 1           WAR II VETERAN".
 
 2      These designations shall be imprinted on the left side of
 
 3 the license plates in a manner similar to congressional and
 
 4 honorary consul license plates.
 
 5      (c)  Registration certificates and license plates issued
 
 6 under this section shall not be transferable to any other person.
 
 7 Special number plates for military service shall be assigned to
 
 8 only one noncommercial passenger motor vehicle or one
 
 9 noncommercial motorcycle or motor scooter registered in the name
 
10 of the qualified applicant and shall be limited to only one
 
11 category of special number plates for military service; provided
 
12 that, if the qualified applicant is the registered owner of a
 
13 noncommercial passenger motor vehicle and a noncommercial
 
14 motorcycle or motor scooter, a second special number plate for
 
15 military service of the same or different category may be
 
16 assigned to the qualified applicant's motorcycle or motor
 
17 scooter.  Prior to the transfer of the ownership of the qualified
 
18 person's vehicle to another party, the special number plates
 
19 shall be surrendered to the director of finance as a condition to
 
20 the issuance of replacement special number plates, provided that
 
21 the director of finance shall allow the survivor of the qualified
 
22 person, upon request, to retain the front special number plate as
 
23 a memorial.

 1      (d)  The director of finance shall authorize the design of a
 
 2 license plate that is readily identifiable and distinguishable
 
 3 under actual traffic conditions and shall adopt rules pursuant to
 
 4 chapter 91 to carry out this section."
 
 5      SECTION 2 .  New statutory material is underscored.
 
 6      SECTION 3.  This Act shall take effect upon its approval.
