                   A  BILL  FOR  AN  ACT

RELATING TO FINES. 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 291C-171, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "§291C-171  Disposition of fines and forfeitures.(a)  All
 
 4 fines and forfeitures collected upon conviction or upon the
 
 5 forfeiture of bail of any person charged with a violation of any
 
 6 section or provision of the state traffic laws and all
 
 7 assessments collected relating to the commission of traffic
 
 8 infractions shall be paid to the director of finance of the
 
 9 [State.] county in which the violation occurred.
 
10      (b)  In addition to any monetary assessment imposed for a
 
11 traffic infraction, the court may impose penalties on all
 
12 outstanding traffic citations and judgments.  The penalties shall
 
13 be established pursuant to rules approved by the supreme court;
 
14 provided that the amounts of the penalties shall be based upon a
 
15 graduated scale that increases in proportion to the length of the
 
16 delinquency.  Any interest penalty imposed as provided in this
 
17 section may be waived by the court for good cause.  All penalties
 
18 collected for such outstanding citations and judgments shall be
 
19 paid to the director of finance of the [State.] county in which

 1 the violation for which the traffic citation and judgment were
 
 2 issued occurred."
 
 3      SECTION 2.  Section 706-643, Hawaii Revised Statutes, is
 
 4 amended by amending subsection (2) to read as follows:
 
 5      "(2)  All fines and other final payments received by a clerk
 
 6 or other officer of a court shall be accounted for, with the
 
 7 names of persons making payment, and the amount and date thereof,
 
 8 being recorded.  All such funds shall be deposited with the
 
 9 director of finance to the credit of the general fund of the
 
10 State[.]; provided that disposition of all fines imposed and
 
11 received for violating chapters 291 and 291C shall be made
 
12 pursuant to section 291C-171.  With respect to fines and bail
 
13 forfeitures which are proceeds of the wildlife revolving fund
 
14 under section 183D-10.5, the director of finance shall transmit
 
15 the fines and forfeitures to that fund."
 
16      SECTION 3.  Statutory material to be repealed is bracketed.
 
17 New statutory material is underscored.
 
18      SECTION 4.  This Act shall take effect upon its approval.
