                   A  BILL  FOR  AN  ACT

RELATING TO STATE RISK MANAGEMENT. 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 41D-4, Hawaii Revised Statutes, is
 
 2 amended by amending subsections (b) and (c) to read as follows:
 
 3      "(b)  In addition to any appropriation the legislature shall
 
 4 make to the state risk management revolving fund, the comptroller
 
 5 [may] shall apportion to, and collect from, state agencies those
 
 6 amounts of money that, in the discretion of the comptroller,
 
 7 reflect benefits received by the agencies under this chapter.
 
 8 The comptroller [may] shall consider the relevant risk and loss
 
 9 experience of the agencies in making apportionments and
 
10 assessments.  Funds so collected shall be deposited into the
 
11 state risk management revolving fund.
 
12      (c)  [The comptroller may establish deductibles for the
 
13 state agencies for certain perils or classes of property losses
 
14 and may:
 
15      (1)  Assess the agencies for losses incurred in the amount
 
16           of the deductible; or
 
17      (2)  Reduce the payment from the state risk management
 
18           revolving fund to cover the casualty loss by the amount
 
19           of the deductible.] The comptroller shall prepare a

 1 report, for each fiscal year, for each agency that is subject to
 
 2 subsection (b), stating the amount apportioned to, and to be
 
 3 collected from, that agency.  The report shall be submitted to
 
 4 the agency and to the legislature no later than one hundred
 
 5 forty-five days before the commencement of each regular session
 
 6 of the legislature preceeding the fiscal year applicable to the
 
 7 apportionment."
 
 8      SECTION 2.  Statutory material to be repealed is bracketed.
 
 9 New statutory material is underscored.
 
10      SECTION 3.  This Act shall take effect on July 1, 2000.
