DESCRIPTION:
Allows the chief of police of each county to enforce the laws of
the State in a county other than the county in which the chief
has been appointed, for any law enforcement purpose within the
State (rather than only to pursue an investigation commenced

                   A  BILL  FOR  AN  ACT

RELATING TO POLICE DEPARTMENTS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 52D-5, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "[[]§52D-5[]]  Powers of chief of police outside own county.
 
 4 The chief of police of each county and any duly authorized
 
 5 subordinates shall have and may exercise all powers, privileges,
 
 6 and authority necessary to enforce the laws of the State, in a
 
 7 county other than the county in and for which the chief has been
 
 8 appointed, if:
 
 9      (1)  The exercise of such power, privilege, and authority is
 
10           required [in the pursuit of any investigation
 
11           commenced] for any law enforcement purpose within the
 
12           [county in and for which the chief has been appointed;]
 
13           State; and
 
14      (2)  The concurrence of the chief of police of the county in
 
15           which the power, privilege, and authority sought to be
 
16           exercised is obtained."
 
17      SECTION 2.  This Act does not affect rights and duties that
 
18 matured, penalties that were incurred, and proceedings that were
 
19 begun, before its effective date.

 1      SECTION 3.  Statutory material to be repealed is bracketed.
 
 2 New statutory material is underscored.
 
 3      SECTION 4.  This Act shall take effect upon its approval.
