                   A  BILL  FOR  AN  ACT
RELATING TO THE DUTIES OF THE DIRECTOR OF HUMAN RESOURCES
   DEVELOPMENT.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that the duties of the
 
 2 director of human resources development are specified
 
 3 appropriately in section 76-13, Hawaii Revised Statutes, in terms
 
 4 of objectives or results expected except for paragraph (8), which
 
 5 imposes methodological limits on the classification system.  A
 
 6 traditional classification system, as prescribed by the current
 
 7 statutes, was the only accepted methodology in the 1950s.  Thus,
 
 8 the statutes now require that the classification system contain
 
 9 classes of work that must be described in class specifications
 
10 with specific, detailed characteristics.  Since that time,
 
11 alternative methodologies (e.g., broadbanding and quantified
 
12 systems) have been developed and offer advantages in timeliness,
 
13 appropriateness, and flexibility.
 
14      Removing the detailed methodological requirements from the
 
15 statutes will permit the director of human resources development
 
16 to revise the classification system to reflect current
 
17 methodologies and alternative approaches where appropriate in
 
18 order to assure timely and appropriate action.
 
19      The purpose of this Act is, therefore, to permit the

 1 director of human resources development to revise the
 
 2 classification plan to reflect current methodologies and
 
 3 alternative approaches, where appropriate, in order to assure
 
 4 timely and appropriate action.
 
 5      SECTION 2.  Section 76-13, Hawaii Revised Statutes, is
 
 6 amended to read as follows:
 
 7      "§76-13  Specific duties and powers of director.  The
 
 8 director of human resources development shall direct and
 
 9 supervise all the administrative and technical activities of the
 
10 director's department.  In addition to other duties imposed upon
 
11 the director by this chapter and chapter 77, the director shall:
 
12     [(1)  Attend all meetings of the commission;
 
13      (2)] (1)  Establish and maintain a roster of all persons in
 
14           the civil service [in which shall be set forth, as to
 
15           each, the class of position held, the salary or pay,
 
16           any change in class, title, pay, or status, and any
 
17           other necessary data];
 
18     [(3)] (2)  Appoint assistants and employees necessary to
 
19           assist the director in the proper performance of the
 
20           director's duties and for which appropriations shall
 
21           have been made;
 
22     [(4)] (3)  Foster and develop, in cooperation with appointing

 1           authorities and others, programs for the improvement of
 
 2           employee efficiency;
 
 3     [(5)] (4)  Cooperate fully with appointing authorities in the
 
 4           administration of this chapter and chapter 77 in order
 
 5           to promote public service and establish conditions of
 
 6           service that will attract and retain employees of
 
 7           character and capacity, and to increase efficiency and
 
 8           economy in governmental departments by the improvement
 
 9           of methods of human resources administration with full
 
10           recognition of the requirements and needs of
 
11           management;
 
12     [(6)] (5)  Encourage and exercise leadership in the
 
13           development of effective human resources administration
 
14           within the several departments in civil service and
 
15           make available the facilities of the director's
 
16           department to this end;
 
17     [(7)] (6)  Investigate from time to time the operation and
 
18           effect of this chapter and chapter 77 and of the rules
 
19           adopted thereunder;
 
20     [(8)] (7)  Develop and maintain a position classification
 
21           [plan; and
 
22           (A)  Create and adjust classes of positions and adopt

 1                class specifications including title, description
 
 2                of typical duties and responsibilities, statement
 
 3                of training and experience, and other requirements
 
 4                to be met by applicants, covering all positions;
 
 5           (B)  Allocate each position and each newly created
 
 6                position to the appropriate class;
 
 7           (C)  Reallocate positions to recognize material changes
 
 8                in duties and responsibilities or to correct a
 
 9                previous action;] system using professionally
 
10                recognized techniques
 
11      (8)  Determine the status of employees affected by
 
12           classification actions; provided that reallocations
 
13           shall be made effective retroactively to the beginning
 
14           of the pay period immediately following the date the
 
15           application for reallocation was filed with the
 
16           director or any other date provided by the rules; and
 
17           provided further that an employee who is otherwise
 
18           properly compensated shall not be required to make
 
19           reimbursement of overpayment in salary when the
 
20           overpayment is due to salary increments or repricing
 
21           actions nullified by the retroactive feature of a
 
22           classification action; and provided further that the

 1           proper salary adjustment shall be made as of the first
 
 2           pay period following the action taken by the director;
 
 3           [and
 
 4           (D)  Determine the status of employees holding
 
 5                positions affected by classification actions;]
 
 6      (9)  Pay any claims against the State as required under
 
 7           chapter 386; and
 
 8     (10)  Perform any other lawful acts deemed by the director to
 
 9           be necessary or desirable to carry out the purposes and
 
10           provisions of this part."
 
11      SECTION 3.  Statutory material to be repealed is bracketed.
 
12 New statutory material is underscored.
 
13      SECTION 4.  This Act shall take effect upon its approval.
