                   A  BILL  FOR  AN  ACT

RELATING TO SCHOOL HEALTH SERVICES. 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that the scope and
 
 2 complexity of health related problems and needs in many public
 
 3 schools have increased significantly since the school health
 
 4 services pilot project was created by Act 130, Session Laws of
 
 5 Hawaii 1970.  Today, school health aides must deal with new
 
 6 problems, including teen pregnancy, family violence, divorce,
 
 7 gang involvement, and the use of prescription medication for
 
 8 various health problems.
 
 9      The legislature further finds that the work of school health
 
10 aides, such as providing first aid and emergency care, preventive
 
11 health care, and record keeping, cannot be completed at certain
 
12 large schools in the time within which the compensation of health
 
13 aides is based, due to the large caseload.  Many health aides at
 
14 large secondary and middle schools work without compensation
 
15 beyond the six and one-half hour work day.
 
16      The purpose of this Act is to improve the safety and health
 
17 of Hawaii's students by establishing a pilot project to expand
 
18 the work hours of school health aides from six and one-half hours
 
19 to eight hours a day at large secondary and middle schools

 1 statewide.
 
 2      SECTION 2.  There is established under the department of
 
 3 health a school health aides expanded work hours pilot project.
 
 4 School health aides employed under the project shall have a
 
 5 workday of eight hours rather than six and one-half hours,
 
 6 section 321-245, Hawaii Revised Statutes, to the contrary
 
 7 notwithstanding.  The department of education shall designate
 
 8 twelve schools, secondary and middle schools, from the islands of
 
 9 Oahu, Maui, Kauai, and Hawaii, with enrollments in excess of one
 
10 thousand seven hundred fifty students, for participation in the
 
11 project.
 
12      School health aides employed under the pilot project shall
 
13 be compensated in accordance with section 321-245, Hawaii Revised
 
14 Statutes, except that the compensation shall be based on an eight
 
15 hour work day.
 
16      SECTION 3.  The department of health shall submit a
 
17 preliminary report to the legislature no later than twenty days
 
18 before the convening of the regular session of 2000, and a final
 
19 report no later than twenty days before the convening of the
 
20 regular session of 2001, on the progress, experience, and
 
21 recommendations for the expansion, improvement, or continuation
 
22 of the pilot project. 
 
23      SECTION 4.  There is appropriated out of the general

 1 revenues of the State of Hawaii the sum of $           , or so
 
 2 much thereof as may be necessary for fiscal year 1999-2000, and
 
 3 the same sum, or so much thereof as may be necessary for fiscal
 
 4 year 2000-2001, for additional compensation for school health
 
 5 aides who are employed under the school health aides expanded
 
 6 work hours pilot project.  
 
 7      SECTION 5.  The sums appropriated shall be expended by the
 
 8 department of health for the purposes of this Act.
 
 9      SECTION 6.  This Act shall take effect on July 1, 1999, and
 
10 shall be repealed on June 30, 2001.
