Alternate Education.


DESCRIPTION:
Establishes alternative education options for students who are
expelled, suspended, or cause chronic disruption to the
educational process.  Appropriates $90,000 to fund and establish
9 sites across the State.  Allows the DOE to contract with
private providers for this service, but does not make it

                   A  BILL  FOR  AN  ACT

RELATING TO EDUCATION.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that it is critical to
 
 2 provide all public school students with safe school environments.
 
 3 Consequently, the legislature has supported the schools through
 
 4 the adoption of acts which allow the long-term exclusion from
 
 5 school of students who commit serious offenses.  Schools,
 
 6 however, need additional options and mechanisms to readily remove
 
 7 from campus students who impede the learning process from
 
 8 occurring in a safe and orderly environment.  At the same time,
 
 9 the department of education recognizes its obligation to provide
 
10 these students with substitute educational activities.
 
11      SECTION 2.  There is appropriated out of the general
 
12 revenues of the State of Hawaii the sum of $90,000, or so much
 
13 thereof as may be necessary, for fiscal year 1999-2000, to
 
14 establish alternative education options in nine sites across the
 
15 state for students who are expelled, suspended or whose presence
 
16 on campus has been determined to be a disruption or detriment to
 
17 the educational process.  Placement of students in these
 
18 alternative education options shall be at the principal's
 
19 discretion.  Each school placing students in these alternative

 1 options shall pay the pro-rated, statewide per pupil expenditure
 
 2 for average daily attendance for each student enrolled.  The
 
 3 department of education may contract with a private provider for
 
 4 services related to these alternative educational options.
 
 5 Contracted private providers shall provide sound instruction
 
 6 using curriculum materials that are aligned with the Hawaii
 
 7 Content and Performance Standards.
 
 8      SECTION 3.  The sum appropriated shall be expended by the
 
 9 department of education for the purposes of this Act.  
 
10      SECTION 4.  This Act shall take effect on July 1, 1999.
