                   A  BILL  FOR  AN  ACT

RELATING TO HIRING RETIRED POLICE OFFICERS IN THE DEPARTMENT OF
   EDUCATION. 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The department of education, in its efforts to
 
 2 educate the children of this State to the maximum extent
 
 3 possible, recognizes that providing a safe and secure school
 
 4 environment will enable pupils and teachers to concentrate on
 
 5 academics without being distracted with disruptions and the
 
 6 threat of injury.
 
 7      It is increasingly clear that to create a safe school
 
 8 environment the quality of the department of education's school
 
 9 security attendants must be raised to a higher level.  In many of
 
10 our secondary schools, understanding law enforcement powers,
 
11 strategies, and techniques are deemed necessary in ensuring the
 
12 safety of students and staff.
 
13      The department of education believes that there is a sizable
 
14 number of retired police officers who are highly trained, ready,
 
15 and willing to assume school security-related positions or school
 
16 security attendant positions provided they could be hired on a
 
17 full-time basis without the loss of their current retirement
 
18 benefits.
 
19      The purpose of this Act is to allow the department of

 1 education to hire qualified retired police officers as security
 
 2 personnel on a full-time, contractual basis.
 
 3      SECTION 2.  Chapter 302A, Hawaii Revised Statutes, is
 
 4 amended by adding a new section to be appropriately designated
 
 5 and to read as follows:
 
 6      "§302A-     Security personnel; hiring.  (a)  The department
 
 7 of education may employ qualified retired police officers at up
 
 8 to one hundred per cent full-time equivalent in school security-
 
 9 related positions or school security attendant positions, where
 
10 the understanding of law enforcement powers, strategies, and
 
11 techniques are deemed necessary in ensuring the safety and
 
12 security of students and staff.  The schools for which these
 
13 retired officers shall be hired shall be identified by the
 
14 department, with prior approval of the superintendent of
 
15 education and pursuant to collective bargaining agreements.
 
16      (b)  Sections 88-21, 88-42.5, 88-43, 88-45, and 88-46, and
 
17 any other statute to the contrary notwithstanding, those retired
 
18 police officers who are hired pursuant to this section shall not
 
19 reenter the employees' retirement system, earn retirement service
 
20 credit, contribute to the retirement system, or gain additional
 
21 retirement system benefits as a result of this employment;
 
22 provided that the retired police officer shall continue to
 
23 receive any retirement benefits without penalty to which the

 1 retired officer is already entitled."
 
 2      SECTION 3.  New statutory material is underscored.
 
 3      SECTION 4.  This Act shall take effect on July 1, 1999.
