                   A  BILL  FOR  AN  ACT

RELATING TO SCHOOL BUSES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 286-181, Hawaii Revised Statutes, is
 
 2 amended by amending subsection (b) to read as follows:
 
 3      "(b)  The department of transportation may grant exemptions
 
 4 for the use of vehicles other than school vehicles when the
 
 5 department finds that compliance with this section is:
 
 6      (1)  Impossible due to the unavailability of school
 
 7           vehicles; or
 
 8      (2)  Impractical due to economic factors[.];
 
 9 provided that nothing in this section shall prohibit the use of
 
10 tour buses solely for the transportation of high school student
 
11 groups to and from school-related events or activities.  As used
 
12 in this section, tour bus is defined as a motor coach that
 
13 carries more than 25 passengers, has a gross vehicle weight
 
14 rating of at least 26,000 pounds, and is no more than 15 years
 
15 old.  No exemption shall be granted for the qualifications of
 
16 individuals driving a bus as defined in section 286-2 and such
 
17 individuals shall meet school vehicle driver qualifications."

 1      SECTION 2.  Statutory material to be repealed is bracketed.
 
 2 New statutory material is underscored.
 
 3      SECTION 3.  This Act shall take effect upon it approval and
 
 4 shall be repealed on July 1, 2002.
