services from a contractor that has a contract with the Federal

                   A  BILL  FOR  AN  ACT

RELATING TO PROCUREMENT. 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 103D, Hawaii Revised Statutes, is
 
 2 amended by adding a new section to be appropriately designated
 
 3 and to read as follows:
 
 4      "§103D-    General Services Administration contractors.  The
 
 5 chief procurement officer of a purchasing agency may procure
 
 6 products and services from a General Services Administration
 
 7 contractor at the price and terms available in a contract between
 
 8 the contractor and the General Services Administration of the
 
 9 federal government, upon determining that the price and terms in
 
10 that contract of the product or service sought to be procured are
 
11 fair, reasonable, and most advantageous to the purchasing agency.
 
12 This section shall not prohibit the chief procurement officer
 
13 from negotiating with the General Services Administration
 
14 contractor a lower price or better terms.
 
15      For purposes of this section, "General Services
 
16 Administration contractor" means a contractor who has a valid and
 
17 unexpired contract with the General Services Administration of
 
18 the federal government to provide products or services at
 
19 specified prices which are solicited by the purchasing agency."

 1      SECTION 2.  Section 103D-301, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "[[]§103D-301[]]  Methods of source selection.  Unless
 
 4 otherwise authorized by law, all contracts shall be awarded by
 
 5 competitive sealed bidding pursuant to section 103D-302, except
 
 6 as provided in:
 
 7      (1)  Section 103D-303 (Competitive sealed proposals);
 
 8      (2)  Section 103D-304 (Professional services procurement);
 
 9      (3)  Section 103D-305 (Small purchases);
 
10      (4)  Section 103D-306 (Sole source procurement); [and]
 
11      (5)  Section 103D-307 (Emergency procurements)[.]; and
 
12      (6)  Section 103D-    (Government Services Administration
 
13           contractor)."
 
14      SECTION 3.  Statutory material to be repealed is bracketed.
 
15 New statutory material is underscored.
 
16      SECTION 4.  This Act shall take effect upon its approval.
