Requires the DOH to assist the counties in the development of
plans for the operation of household hazardous waste collection,
recycling, and disposal programs.  Appropriates funds to the DOH

                   A  BILL  FOR  AN  ACT

RELATING TO HOUSEHOLD HAZARDOUS WASTE.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that because household
 
 2 hazardous substances are an integral part of daily life,
 
 3 households throughout the State would benefit tremendously
 
 4 through the development and publication of practical and
 
 5 consistent information on hazardous substances in the household
 
 6 and the establishment of an ongoing county hazardous waste
 
 7 collection program.  The public education program of the
 
 8 department of health is currently mandated to provide the public
 
 9 with information regarding household hazardous waste.  Thus far,
 
10 however, an ongoing program to permit households throughout the
 
11 State to discard unwanted hazardous substances has not been
 
12 established.
 
13      When stored in the home, hazardous substances may present a
 
14 threat to the safety of the members of the household.  When
 
15 disposed of improperly or discarded in the household trash,
 
16 hazardous substances can pose a threat to the environment, the
 
17 general public, as well as the sanitation workers that handle
 
18 them.  In this regard, the legislature finds that households
 
19 throughout the State should be provided with reasonable access to

 1 a legal, convenient, and environmentally sound method of
 
 2 disposing hazardous substances.
 
 3      The legislature finds that the counties of the State should
 
 4 be provided with all the proper assistance needed to develop and
 
 5 maintain a program to collect hazardous substances in the
 
 6 household.  The purpose of this Act is to require the department
 
 7 of health to assist the counties in the development of household
 
 8 hazardous waste plans and the establishment of household
 
 9 hazardous waste collection programs.
 
10      SECTION 2.  Chapter 342J, Hawaii Revised Statutes, is
 
11 amended by adding a new part to be appropriately designated and
 
12 to read as follows:
 
13           "PART   .  HOUSEHOLD HAZARDOUS WASTE DISPOSAL
 
14      §342J-    Household hazardous waste disposal council;
 
15 established.(a)  There is established within the department for
 
16 administrative purposes, a household hazardous waste disposal
 
17 council that shall be advisory to the department and the
 
18 counties.
 
19      (b)  The council shall be composed of eleven members
 
20 appointed by the governor in accordance with section 26-34.  The
 
21 members of the council shall represent state, county, and
 
22 business interests involved in hazardous waste management.  The

 1 members of the council shall not be compensated but shall be
 
 2 reimbursed for expenditures incurred during the performance of
 
 3 their duties, including travel expenses.
 
 4      §342J-    Powers and duties.  The council shall:
 
 5      (1)  Prepare guidelines and a state policy, consistent with
 
 6           this chapter, to assist county agencies providing
 
 7           household hazardous waste collection, recycling, and
 
 8           disposal services;
 
 9      (2)  Develop a model operation plan for county household
 
10           hazardous waste collection, recycling, and disposal
 
11           programs;
 
12      (3)  Assist the counties in the development, adoption, and
 
13           implementation of county household hazardous waste
 
14           collection program plans;
 
15      (4)  Establish guidelines on the generic types of household
 
16           hazardous substances that may exhibit properties of a
 
17           hazardous waste as defined in section 342J-2;
 
18      (5)  Assist the department in the development of an ongoing
 
19           information program to inform the public of the
 
20           existence of county household hazardous waste
 
21           collection programs;
 
22      (6)  Advise the department on the need to amend laws and

 1           adopt rules regarding household hazardous waste
 
 2           management; and
 
 3      (7)  Advise the department on the status of county programs,
 
 4           the problems confronting these programs, and the
 
 5           assistance required by the counties to operate their
 
 6           programs.
 
 7      §342J-    County household hazardous waste collection
 
 8 programs.(a)  Prior to June 30, 2001, each county of the State
 
 9 shall submit for the approval of the council, a county household
 
10 hazardous waste collection program plan for the collection of
 
11 household hazardous wastes generated in the county.
 
12      Each county, in cooperation with the council, shall develop,
 
13 adopt, and implement plans and rules necessary for the
 
14 implementation of the county program.  The county household
 
15 hazardous waste collection program plan shall be patterned after
 
16 the model operation plan developed by the council.
 
17      (b)  Following the approval of the county household
 
18 hazardous waste collection plan by the council, each county shall
 
19 establish a household hazardous waste collection program for the
 
20 collection of household hazardous wastes generated in the
 
21 county."
 
22      SECTION 3.  Section 342J-42, Hawaii Revised Statutes, is

 1 amended to read as follows:
 
 2      "[[]§342J-42[]]  Public education program.  (a)  The
 
 3 department shall develop and implement a public education
 
 4 program, the objectives of which shall be to:
 
 5      (1)  Develop increased public awareness of and interest in
 
 6           environmentally sound hazardous waste management
 
 7           methods;
 
 8      (2)  Encourage better informed decisions on hazardous waste
 
 9           management issues by businesses, industries, local
 
10           governments, and the public; and
 
11      (3)  Disseminate practical information concerning methods in
 
12           which households, other institutions, and organizations
 
13           can improve the management of hazardous waste.
 
14      (b)  The public information program shall be designed to:
 
15      (1)  Identify the products most commonly utilized in the
 
16           home that contain hazardous constituents;
 
17      (2)  Provide information and suggestions, consistent with
 
18           the product label, on the proper use and storage of
 
19           products that contain hazardous constituents;
 
20      (3)  Provide uniform and consistent information on the
 
21           proper disposal of hazardous wastes commonly generated
 
22           in the home; and

 1      (4)  Provide information and assistance to the counties in
 
 2           their effort to advertise and promote their programs
 
 3           and collect, recycle, and dispose of household
 
 4           hazardous wastes."
 
 5      SECTION 4.  There is appropriated out of the general
 
 6 revenues of the State of Hawaii the sum of $          , or so
 
 7 much thereof as may be necessary for fiscal year 1999-2000, to
 
 8 assist the counties in the development of county household
 
 9 hazardous waste collection program plans and the establishment of
 
10 county household hazardous waste collection programs.
 
11      The sum appropriated shall constitute the State's share of
 
12 the cost of mandated programs under article VIII, section 5 of
 
13 the state constitution.
 
14      The sum appropriated shall be expended by the department of
 
15 health for the purposes of this Act.
 
16      SECTION 5.  Statutory material to be repealed is bracketed.
 
17 New statutory material is underscored.
 
18      SECTION 6.  This Act shall take effect on July 1, 1999.
