                   A  BILL  FOR  AN  ACT

RELATING TO THE BOARD OF EDUCATION.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  (a)  There is established a commission on the
 
 2 election of the board of education, which shall be placed in the
 
 3 office of the chief election officer for administrative purposes.
 
 4 The commission shall:
 
 5      (1)  Determine methods to apportion districts for the
 
 6           election of members of the board of education, without
 
 7           regard to permanent residency as the only criterion for
 
 8           apportionment.  The commission shall apply the
 
 9           principle of "one person, one vote";
 
10      (2)  Recommend proposals to amend constitutional and
 
11           statutory requirements affecting the composition of the
 
12           board of education; and
 
13      (3)  Report its findings and recommendations to the
 
14           legislature.
 
15      (b)  The commission shall be composed of the following nine
 
16 members:
 
17      (1)  Two members to be appointed by the board of education;
 
18      (2)  Three members to be appointed by the governor; and
 
19      (3)  Two members each to be appointed by the governor from

 1           lists of five names submitted by the president of the
 
 2           senate and the speaker of the house of representatives,
 
 3           respectively.
 
 4      (c)  The department of education and the chief election
 
 5 officer shall provide staff and technical support to the
 
 6 commission.
 
 7      (d)  The members of the commission shall receive no
 
 8 compensation, but shall be reimbursed for travel and other
 
 9 necessary expenses incurred in the performance of their duties.
 
10      (e)  The commission shall be convened by January 1, 2000,
 
11 and shall elect a chairperson from among its membership by
 
12 majority vote.  The business of the commission shall be to
 
13 present a report, including proposed legislation, to the
 
14 legislature no later than twenty days before the convening of the
 
15 regular session of 2001.  The commission shall be disbanded upon
 
16 the adjournment sine die of the 2001 regular session of the
 
17 legislature.
 
18      SECTION 2.  There is appropriated out of the general
 
19 revenues of the State of Hawaii the sum of $        , or so much
 
20 thereof as may be necessary for fiscal year 1999-2000, to carry
 
21 out the purposes of this Act, including the hiring of necessary

 1      SECTION 3.  The sum appropriated shall be expended by the
 
 2 department of education for the purposes of this Act.
 
 3      SECTION 4.  This Act shall take effect on July 1, 1999.
