                   A  BILL  FOR  AN  ACT

RELATING TO THE HAWAII WATER CARRIER ACT.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 271G, Hawaii Revised Statutes, is
 
 2 amended by adding a new section to be appropriately designated
 
 3 and to read as follows:
 
 4      "§271G-    Tariffs of water carriers; discount provisions
 
 5 for island agricultural products.  (a)  With respect to any rate,
 
 6 fair, tariff, or charge approved by the public utilities
 
 7 commission under section 271G-17, the commission shall prescribe
 
 8 a discount to the rate, fair, tariff, or charge to be applied by
 
 9 the carrier for the transportation of island agricultural
 
10 products.  For the purposes of this section, the term "island
 
11 agricultural products" means fresh or processed agricultural
 
12 products grown or produced in Hawaii, including pineapple, sugar,
 
13 fruits, vegetables, coffee, hay, whole eggs, juices, macadamia
 
14 nuts, onions, potatoes, milk, meats, poultry, flowers, and
 
15 flowering and ornamental plants.
 
16      (b)  In the event of a conflict between this section and
 
17 section 271G-17, this section shall control."
 
18      SECTION 2.  New statutory material is underscored.
