REPORT TITLE:
Foster Boarding Homes


DESCRIPTION:
Changes the need for annual criminal history checks for foster
boarding homes after the first two years, so that the subsequent
checks may be annual or biennial, in conjunction with the
certification schedule of the home.  Allows foster boarding homes
to care for more than five children to accommodate sibling

                   A  BILL  FOR  AN  ACT

RELATING TO FOSTER BOARDING HOMES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 346-16, Hawaii Revised Statutes, is
 
 2 amended by amending the definitions of "criminal history record
 
 3 check" and "foster boarding home" in subsection (a) to read as
 
 4 follows:
 
 5      ""Criminal history record check" means an examination of an
 
 6 individual's criminal history record through:
 
 7      (1)  An initial fingerprint analysis and name inquiry into
 
 8           state and national criminal history record files;
 
 9      (2)  Subsequent fingerprint analyses for new hires and
 
10           rehires; and
 
11      (3)  [An annual] A name inquiry into the state criminal
 
12           history record files[.], which shall be made annually
 
13           for the first two years of certification, and annually
 
14           or biennially thereafter, in conjunction with the
 
15           certification schedule.
 
16      "Foster boarding home" means [any]:
 
17      (1)  Any boarding home in which one or more, but fewer than
 
18           six, minor children are received for care and
 
19           maintenance apart from their parents or guardians on a

 1           [twenty-four hour] twenty-four-hour basis for fee or
 
 2           charge[.]; and
 
 3      (2)  Any boarding home in which six or more minor siblings
 
 4           are placed together in the best interests of the
 
 5           children for care and maintenance apart from their
 
 6           parents or guardians on a twenty-four-hour basis for
 
 7           fee or charge."
 
 8      SECTION 2.  Statutory material to be repealed is bracketed.
 
 9 New statutory material is underscored.
 
10      SECTION 3.  This Act shall take effect on July 1, 1999.
