                   A  BILL  FOR  AN  ACT

RELATING TO THE CIVIL SERVICE SYSTEM FOR PUBLIC OFFICERS AND
EMPLOYEES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The book Reinventing Government has become the
 
 2 catalyst for focusing on the need to change government to be more
 
 3 efficient, effective and responsive to the needs of the public.
 
 4 Osborne and Plastrik in their book "Banishing Bureaucracy" have
 
 5 defined "reinvention" as meaning the fundamental transformation
 
 6 of public systems and organizations to create dramatic increases
 
 7 in their effectiveness, efficiency, adaptability, and capacity to
 
 8 innovate.  This transformation is accomplished by changing their
 
 9 purpose, incentives, accountability, power structure and
 
10 culture."
 
11      The public and executive branch agency outcries resonate
 
12 everywhere that the civil service system has become an
 
13 overburdensome hierarchy and exitless labyrinth of laws, rules
 
14 and regulations that seem to only serve the purpose of thwarting
 
15 rather than promoting and facilitating the ability of government
 
16 agencies to be more responsive to meeting the public needs.
 
17      It is clear that we must begin to reduce complexity and to
 
18 make government more people centered by ensuring that government
 
19 is responsive to serving the needs of the people and the workers

 1 who provide those services. To do this we must craft civil
 
 2 service legislation that will provide a new legal framework and
 
 3 climate which encourages partnerships between labor and
 
 4 management based on mutual recognition and respect.
 
 5      To set the stage and promote the need to work together to
 
 6 craft this new civil service, it is proposed that a sunset
 
 7 provision be established for civil service and collective
 
 8 bargaining laws.  Such a sunset concept would serve to "clear-
 
 9 the-deck" and make readily apparent the need to seriously engage
 
10 in the process of creating a new statutory framework.  It is
 
11 further proposed that the director of human resources development
 
12 be charged with the responsibility to design and effectuate a
 
13 process to reconsider the civil service system by establishing
 
14 partnerships with all stakeholders.
 
15      SECTION 2.  Chapters 76, 77, 78, 79, 80, 81, and 82, Hawaii
 
16 Revised Statutes, are repealed.
 
17      SECTION 3.  The director of the department of human
 
18 resources development shall identify and work collaboratively
 
19 with the various stakeholders governed by the provisions of
 
20 Chapters 76, 77, 78, 79, 80, 81, and 82, in order to draft
 
21 replacement legislation if deemed necessary.  The director shall
 
22 submit to the legislature and governor, by January 15, 2000, a
 
23 report of findings, recommendations and proposed replacement

 1 legislation.  The legislature shall hold hearings and consider
 
 2 the recommendations of the director.
 
 3      SECTION 4.  This Act shall take effect on June 30, 2000.
