                   A  BILL  FOR  AN  ACT

RELATING TO RETAIL LIQUOR SALES TO MINORS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 281-101.5, Hawaii Revised Statutes, is
 
 2 amended by amending subsection (b) to read as follows:
 
 3      "(b)  No minor shall purchase liquor and no minor shall have
 
 4 liquor in the minor's possession or custody in any motor vehicle
 
 5 on a public highway or in any public place, public gathering, or
 
 6 public amusement or at any public beach or public park; provided
 
 7 that notwithstanding any other law to the contrary, this
 
 8 subsection shall not apply to [possession]:
 
 9      (1)  Possession or custody of liquor by a minor in the
 
10           course of delivery pursuant to the direction of the
 
11           minor's employer lawfully engaged in business
 
12           necessitating such delivery[, or];
 
13      (2)  Possession or custody of liquor by a minor in
 
14           connection with the minor's authorized participation in
 
15           religious ceremonies requiring such possession or
 
16           custody[.]; or
 
17      (3)  Any person, between the ages of eighteen and twenty,
 
18           who is participating in a controlled purchase as part
 
19           of a law enforcement activity or a study authorized by
 
20           the department of health to determine the level of

 1           incidence of liquor sales to minors."
 
 2      SECTION 2.  Statutory material to be repealed is bracketed.
 
 3 New statutory material is underscored.
 
 4      SECTION 3.  This Act shall take effect upon its approval.
