                     HOUSE  RESOLUTION

  URGING THE DEPARTMENT OF THE ATTORNEY GENERAL AND THE
    DEPARTMENT OF JUSTICE TO CONDUCT AN INVESTIGATION INTO THE
    "PETER BOY" KEMA CASE.



 1        WHEREAS, Peter Kema Jr., also known as "Peter Boy," has
 2   not been seen by his relatives since February 1997; and
 3   
 4        WHEREAS, Peter Boy was alleged to have been given by his
 5   father, Peter Kema Sr. to an old family friend named Auntie
 6   Rose Makuakane during a trip to Oahu in August 1997; and
 7   
 8        WHEREAS, no one can be found who has seen Peter Boy since
 9   that time; and
10   
11        WHEREAS, police have been unable to prove the existence of
12   Makuakane, and the case is being actively investigated as a
13   missing person case; and
14   
15        WHEREAS, while Peter Boy's parents have maintained that
16   they have never harmed the child, the boy's three siblings, who
17   have been placed in foster custody, have provided a disturbing
18   portrait of alleged abuse, including allegations that Peter Boy
19   was starved, forced to sleep outside, driven around in the
20   locked trunk of the family car, and sometimes handcuffed to his
21   bed; and
22   
23        WHEREAS, despite investigation by the Hawaii County Police
24   Department, there has been no apparent progress in the case and
25   no resolution of the question as to the whereabouts of Peter
26   Boy; and
27   
28        WHEREAS, the interests of justice require a resolution of
29   the mystery of Peter Boy's fate; now, therefore,
30   
31        BE IT RESOLVED by the House of Representatives of the
32   Twentieth Legislature of the State of Hawaii, Regular Session
33   of 2000, that the Department of the Attorney General and the
34   U.S. Department of Justice are  urged to investigate the
35   missing person case of "Peter Boy" Kema; and

 1        BE IT FURTHER RESOLVED that, since the case has been
 2   outstanding for over three years, all possible priority should
 3   be given to the case before it becomes impossible to solve; and
 4   
 5        BE IT FURTHER RESOLVED that the U.S. Department of Justice
 6   is requested to investigate to determine if Peter Boy's civil
 7   rights have been violated; and
 8   
 9        BE IT FURTHER RESOLVED that the state Attorney General and
10   the U.S. Department of Justice are requested to submit a report
11   of any findings about the case that can be made public without
12   jeopardizing the progress of the case to the Legislature at
13   least twenty days prior to the convening of the Regular Session
14   of 2001; and
15   
16        BE IT FURTHER RESOLVED that certified copies of this
17   Resolution be transmitted to the Attorney General of the United
18   States, the Attorney General of the State of Hawaii, Hawaii's
19   Congressional Delegation, and to the Police Chief and the
20   Prosecuting Attorney from Hawaii County.
