                     HOUSE  RESOLUTION
  REQUESTING THE AUDITOR TO STUDY THE NEED FOR REGULATING THE
   ALARM INDUSTRY.



 1       WHEREAS, the Honolulu Police Department has found that the
 2   proliferation of security alarm machine spontaneous activations
 3   ("false alarms") is detrimental to public health, safety, and
 4   welfare, and a costly diversion of county resources; and
 5   
 6       WHEREAS, the Honolulu Police Department reports that its
 7   police officers have responded to an average of 34,075 false
 8   alarm calls per year within the last three years, averaging
 9   2,840 false alarm calls a month; and
10   
11       WHEREAS, the Honolulu Police Department and the Hawaii
12   Burglar & Fire Alarm Association believe that the absence of a
13   licensing or permitting program has contributed significantly
14   to the escalating number of false alarm calls; and
15   
16       WHEREAS, H.B. No. 2125 was introduced in the House of
17   Representatives during the Regular Session of 2000 as a vehicle
18   to regulate the alarm industry; and
19   
20       WHEREAS, an analysis by the Auditor is required prior to
21   the enactment of a new regulatory measure that would subject an
22   unregulated profession or vocation to state licensure and other
23   regulatory controls; now, therefore,
24   
25       BE IT RESOLVED by the House of Representatives of the
26   Twentieth Legislature of the State of Hawaii, Regular Session
27   of 2000, that the Auditor is requested to:
28   
29       (1)  Analyze, in accordance with section 26H-6, Hawaii
30            Revised Statutes (HRS), the probable effects of the
31            regulatory system proposed in H.B. No. 2125;
32   
33       (2)  Assess whether the regulatory scheme proposed in H.B.
34            No. 2125 is consistent with state policy as provided
35            in section 26H-2, HRS; and

 2       (3)  Assess alternative forms of regulation of the alarm
 3            industry, and include recommendations on:
 4   
 5            (A)  How alarm providers, as well as alarm users,
 6                 could be regulated;
 7   
 8            (B)  Whether an autonomous board, or a state or county
 9                 agency would be better suited to implement the
10                 regulation; and
11   
12            (C)  The cost impact on the agency, the regulated
13                 group, and alarm users;
14   
15   and
16   
17       BE IT FURTHER RESOLVED that the Auditor is requested to
18   report the Auditor's findings and recommendations to the
19   Legislature no later than twenty days prior to the convening of
20   the Regular Session of 2001; and
21   
22       BE IT FURTHER RESOLVED that certified copies of this
23   Resolution be transmitted to the Auditor and the Police Chief
24   of the Honolulu Police Department.
