                     HOUSE  RESOLUTION

SUPPORTING FEDERAL RECOGNITION OF A HAWAIIAN NATION.



 1       WHEREAS, the United States Congress passed, and the
 2   President signed, Public Law 103-150 (the Apology Law),
 3   acknowledging the illegal overthrow of the Kingdom of Hawaii
 4   and the need for reconciliation between the United States and
 5   Native Hawaiians; and
 6   
 7       WHEREAS, there exists a trust relationship between the
 8   United States and Native Hawaiians, wherein many of the duties
 9   of the United States, through federal acts, including the
10   Hawaiian Homes Commission Act of 1920, as amended, have been
11   delegated to the State of Hawaii for administration; and
12   
13       WHEREAS, there is a need for Congress to effect a clear
14   statement about the political status of Native Hawaiians and to
15   recognize a Hawaiian nation; and
16   
17       WHEREAS, current federal policies and laws allow greater
18   autonomy and self-determination for native peoples, including
19   direct contracting with recognized native governments to
20   administer funds and programs designed to meet the trust
21   obligation of the United States to those peoples; and
22   
23       WHEREAS, it is in the best interest of Native Hawaiians for
24   the United States Government to recognize a Hawaiian nation so
25   as to enjoy a full government-to-government relationship with
26   the United States; and
27   
28       WHEREAS, the State of Hawaii would benefit substantially
29   from the recognition of a Hawaiian nation because it would mean
30   less state responsibility, less burden on state resources and a
31   stimulated economy as Native Hawaiian businesses and programs
32   become available; now, therefore,
33   
34       BE IT RESOLVED by the House of Representatives of the
35   Twentieth Legislature of the State of Hawaii, Regular Session
36   of 2000, that this body supports the sovereign rights of Native
37   Hawaiians and recognizes the need to develop a government-to-
38   government relationship between a Hawaiian nation and the
39   United States; and

 1       BE IT FURTHER RESOLVED that the United States Congress and
 2   the President are respectfully requested to articulate and
 3   implement a federal policy of Native Hawaiian self-government
 4   with a distinct, unique, and special trust relationship and to
 5   implement reconciliation pursuant to Public Law 103-150; and
 6   
 7       BE IT FURTHER RESOLVED that certified copies of this
 8   Resolution be transmitted to the National Congress of American
 9   Indians, the Alaska Federation of Natives, the Governor of the
10   State of Hawaii, the Hawaii congressional delegation, the 106th
11   Congress of the United States, the Secretaries of the
12   Departments of Justice, Interior and State, and the President
13   of the United States.
