                     HOUSE  CONCURRENT
                        RESOLUTION

  ENCOURAGING THE CONSERVATION OF TWO PARCELS OF LAND ADJACENT TO
    LIMAHULI STREAM ON THE ISLAND OF KAUAI FOR THE
    PRESERVATION OF IMPORTANT CULTURAL RESOURCES. 


 1        WHEREAS, the preservation of natural, cultural, and
 2   spiritual resources is essential to the preservation of Native
 3   Hawaiian culture and of utmost importance to the people of
 4   Hawaii; and
 5   
 6        WHEREAS, archaeologists and historians still search for
 7   clues about the lives and customs of the original Polynesian
 8   voyagers who only settled in a few special places throughout
 9   the Hawaiian Islands, one of these being Ha'ena on the island
10   of Kauai; and
11   
12        WHEREAS, the cultural history of Ha'ena, where the great
13   romantic epic of the love triangle between Pele, her younger
14   sister, Hiiakaikapoli O Pele, and Lohiau, a handsome Kauai
15   chief begins, is famous throughout the islands and memorialized
16   in many ancient mo'olelo (legends), oli (chants), mele (songs),
17   and hula (dances); and
18   
19        WHEREAS, the history of land use in this area has always
20   reflected commitment to conservation even after the break up of
21   the traditional stewardship systems; and
22   
23        WHEREAS, in 1983, Ira Goldberg purchased two lots (TMK 5-
24   9-06-10 and 5-9-06-11) situated at the entrance to Limahuli
25   Valley.  These parcels, located between the Ha`ena State Park
26   and the National Tropical Botanical Garden, are rich with
27   archaeological sites, significant to the total cultural
28   importance of the area, including terraces, a pohaku ho'ohanau
29   (birthing stone), and ancient walls and housing sites all dated
30   as early as 1200 A.D.; and
31   
32        WHEREAS, Ira Goldberg has been entrusted in a unique
33   situation and has demonstrated in good faith to provide for the
34   upkeep and preservation of the cultural, historic, and scenic
35   value of his two lots; and

 2        WHEREAS, although these lots are grandfathered for
 3   residential use and the Department of Land and Natural
 4   Resources issued a conservation district use permit in 1982 to
 5   build a 7,000 square foot house on the lots, Ira Goldberg is
 6   now willing to refrain from building that structure because of
 7   the negative cultural, historic, and archaeological impact it
 8   would have on the surrounding area; and
 9   
10        WHEREAS, lands having value as a resource to the State
11   includes land having natural, environmental, recreational,
12   scenic, or historic value which, as in this instance, should be
13   protected from misuse and inappropriate development; now,
14   therefore,
15   
16        BE IT RESOLVED by the House of Representatives of the
17   Twentieth Legislature of the State of Hawaii, Regular Session
18   of 2000, the Senate concurring, that the Legislature
19   acknowledges Ira Goldberg's desire to preserve the culturally
20   significant parcels adjacent to Limahuli Stream and his
21   willingness to refrain from undertaking any development of his
22   land during the next twelve months, during which time he and
23   his representatives will discuss with representatives of the
24   Department of Land and Natural Resources, and others, how best
25   to protect the cultural and archaeological sites; and
26   
27        BE IT FURTHER RESOLVED that Ira Goldberg is encouraged to
28   consider steps to protect his lots from misuse, by, for
29   example, granting a conservation easement in perpetuity to the
30   State of Hawaii and/or some other appropriate entity; and
31   
32        BE IT FURTHER RESOLVED that the Department of Land and
33   Natural Resources is requested to submit a report on the
34   actions taken to protect the culturally and environmentally
35   significant sites situated on Ira Goldberg's property not later
36   than twenty days prior to the convening of the 2001 regular
37   session; and
38   
39        BE IT FURTHER RESOLVED that certified copies of this
40   Resolution be transmitted to the Department of Land and Natural
41   Resources, Ira Goldberg, Hui Maka'ainana O Makana
