                   A  BILL  FOR  AN  ACT
RELATING TO MENTAL HEALTH SERVICES IN COMMUNITY RESIDENTIAL CARE
   FACILITIES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 334-3, Hawaii Revised Statutes, is
 
 2 amended by amending subsection (a) to read as follows:
 
 3      "(a)  The department of health within the limits of
 
 4 available funds within the designated programs, shall promote and
 
 5 provide for the establishment and operation of a community-based
 
 6 mental health system responsive to the needs of persons of all
 
 7 ages, ethnic groups, and geographical areas of the State,
 
 8 reflective of an appropriate distribution of resources and
 
 9 services, and monitored and evaluated in terms of standards, goal
 
10 attainment, and outcomes.  The elements of the system shall be
 
11 defined by departmental rules recognizing the need for at least
 
12 the following services:
 
13      (1)  Informational and educational services to the general
 
14           public and to lay and professional groups;
 
15      (2)  Collaborative and cooperative services with public and
 
16           private agencies and groups for the prevention and
 
17           treatment of mental or emotional disorders and
 
18           substance abuse and rehabilitation of patients;
 
19      (3)  Consultation services to the judiciary, to educational

 1           institutions, and to health and welfare agencies;
 
 2      (4)  Case management, outreach, and follow-up services;
 
 3      (5)  Emergency crisis and noncrisis intervention services
 
 4           accessible to residents of all service areas;
 
 5      (6)  Community-based, relevant, and responsive outpatient
 
 6           services;
 
 7      (7)  Community residential care comprising a comprehensive
 
 8           range of small, homelike, and appropriately staffed
 
 9           treatment and rehabilitation facilities; provided that
 
10           the department shall adopt rules in accordance with
 
11           chapter 91 to establish standards, including but not
 
12           limited to:
 
13           (A)  The minimum qualifications of community
 
14                residential care home operators;
 
15           (B)  The roles of operators in promoting the mental
 
16                health of occupants;
 
17           (C)  The minimum dietary requirements for occupants in
 
18                a community residential care home;
 
19           (D)  The recreational requirements for occupants in a
 
20                community residential care home;
 
21           (E)  The minimum standards for environmental quality in
 
22                a community residential care home, including
 
23                standards regarding smoking; and

 1           (F)  Any other factor that may negatively affect the
 
 2                health and safety of occupants in a community
 
 3                residential care home;
 
 4      (8)  Short-term psychiatric hospitalization, preferably in
 
 5           facilities where access to other health and medical
 
 6           services are readily available;
 
 7      (9)  Intensive psychiatric hospitalization for patients in
 
 8           need of long-term, highly structured, or highly
 
 9           specialized care and treatment and provision of
 
10           appropriate community resources;
 
11     (10)  Training programs, activities, and staffing standards
 
12           for the major mental health disciplines and ancillary
 
13           services; and
 
14     (11)  Rehabilitative services for hospital and
 
15           community-based individuals who have experienced short-
 
16           or long-term mental or emotional disorders and
 
17           substance abuse."
 
18      SECTION 2.  New statutory material is underscored.
 
19      SECTION 3.  This Act shall take effect upon its approval.
