                     A BILL FOR AN ACT

RELATING TO THE RECYCLING OF BATTERIES AND TIRES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:


 1      SECTION 1.  The legislature finds that existing law is
 
 2 failing to keep discarded lead batteries and tires from ending up
 
 3 in public places, landfills, and illegal dump sites.  The
 
 4 legislature further finds that imposition of a core charge at the
 
 5 point of sale of lead batteries and tires, to be waived only on
 
 6 sales that involve an exchange of at least as many old batteries
 
 7 and tires as those newly purchased, is necessary to encourage
 
 8 proper disposal of both.
 
 9      SECTION 2.  Section 342I-2, Hawaii Revised Statutes, is
 
10 amended to read:
 
11      "§342I-2 Lead acid batteries; collection for recycling.  A
 
12 person selling lead acid batteries at retail or offering lead
 
13 acid batteries for retail sale in the State shall:
 
14      (1)  Accept, at the point of transfer, in a quantity at
 
15           least equal to the number of new batteries purchased,
 
16           used lead acid batteries from customers, if offered by
 
17           customers; and
 
18      (2)  Post written notice that shall be at least five inches
 
19           by seven inches in size and shall contain the universal

 1           recycling symbol and the following language:
 
 2           (A)  "It is illegal to discard a motor vehicle battery
 
 3                or other lead acid battery";
 
 4           (B)  "Recycle your used batteries";
 
 5           (C)  "State law requires us to accept used motor
 
 6                vehicle batteries or other lead acid batteries for
 
 7                recycling, in exchange for new batteries
 
 8                purchased"; and
 
 9           (D)  "The price of a new battery includes disposal of
 
10                your old battery[".] and a core charge of ten
 
11                dollars if no old battery is presented for
 
12                disposal."
 
13      (3)  Any advertising pertaining to the price of lead acid
 
14           batteries shall include the statement "The price
 
15           includes disposal of your old battery[".] and a core
 
16           charge of ten dollars if no old battery is presented
 
17           for disposal.""
 
18      (4)  For businesses utilizing advertising prepared out of
 
19           the State a sign no smaller than three square feet,
 
20           placed at the point of sale stating:  "The price of the
 
21           battery includes disposal of your old battery" may be
 
22           substituted. "
 
23      SECTION 3.  Section 342I-23, Hawaii Revised Statutes, is

 1 amended to read:
 
 2      "[§342I-23]  Motor vehicle tires; collection for recycling.
 
 3 (a)  Each tire retailer shall:
 
 4      (1)  Accept, at the point of transfer, in a quantity at
 
 5           least equal to the number of new motor vehicle tires
 
 6           purchased by a customer, motor vehicle tires offered by
 
 7           the customer.
 
 8      (2)  Post written notice which shall be at least five inches
 
 9           by seven inches in size and easily visible to customers
 
10           and shall contain the universal recycling symbol and
 
11           the following language:
 
12           (A)  "It is illegal to discard a motor vehicle tire";
 
13           (B)  "Recycle your used tires";
 
14           (C)  "State law requires us to accept used motor
 
15                vehicle tires for recycling or disposal, in
 
16                exchange for new tires purchased"; and
 
17           (D)  "The price of a new tire includes disposal of your
 
18                old tire[".] and a core charge of ten dollars if
 
19                no old tire is presented for disposal."
 
20      (b)  The department of health shall produce, print, and
 
21 distribute the notices required by subsection (a)(2) to each
 
22 retailer; provided that a retailer instead may use any sign or
 
23 notice that meets the requirements of that subsection.

 1      (c)  Any advertising pertaining to the price of motor
 
 2 vehicle tires shall include the statement "The price includes
 
 3 disposal of your old tire[."] and a core charge of ten dollars if
 
 4 no old tire is presented for disposal."
 
 5      (d)  For businesses utilizing advertising prepared out of
 
 6 the State a sign no smaller than three square feet, placed at the
 
 7 point of sale stating:  "The price of tires includes disposal of
 
 8 your old tires["]and a core charge of ten dollars for each new
 
 9 tire if no old tire is presented for disposal." may be
 
10 substituted."
 
11      SECTION 4.  Statutory material to be repealed is bracketed.
 
12 New statutory material is underscored.
 
13      SECTION 5.  This Act shall take effect upon its approval.
