                   A  BILL  FOR  AN  ACT

RELATING TO FISHING NETS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 188-29, Hawaii Revised Statutes, is
 
 2 amended by amending subsection (c) to read as follows:
 
 3      "(c)  The department of land and natural resources [may],
 
 4 pursuant to chapter 91, shall adopt rules relating to
 
 5 requirements for the use of nets and escape openings or devices
 
 6 on any type of nets or traps.
 
 7      The rules shall include provisions [describing]:
 
 8      (1)  Describing the type, measurements, and locations of
 
 9           escape openings or devices on traps under this
 
10           subsection and become effective three years after
 
11           establishment[.]; and
 
12      (2)  Regulating the manufacture and use of nets including:
 
13           (A)  Minimum gauge for netting material;
 
14           (B)  The use of nets to prevent violation of section
 
15                188-30.5; and
 
16           (C)  Standards necessary to minimize the problem of
 
17                portions of nets breaking off and thereby becoming
 
18                drift nets."
 
19      SECTION 2.  Statutory material to be repealed is bracketed.
