                     A BILL FOR AN ACT

RELATING TO SALARIES IN THE JUDICIARY.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 608-1.5, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "§608-1.5  Judicial salary commission.  (a)  There shall be
 
 4 a judicial salary commission, to be attached to the judicial
 
 5 council for administrative purposes only, to review and recommend
 
 6 salaries of justices and judges of all state courts and appointed
 
 7 judiciary administrative officers.
 
 8      (b)  The commission shall be composed of five members, two
 
 9 to be appointed by the governor, one by the president of the
 
10 senate, one by the speaker of the house, and one by the chief
 
11 justice.  [Members shall be appointed for terms of four years
 
12 each.]  The members of the commission shall be appointed on or
 
13 before November 30, 2002, and every eight years thereafter.
 
14      (c)  Members shall not receive compensation for their
 
15 services, but shall be reimbursed for traveling and other
 
16 expenses incidental to the performance of commission duties.
 
17      [For administrative purposes only, the commission shall be
 
18 attached to the judicial council.
 
19      By October 15 of each year preceding a fiscal biennium, the
 
20 commission shall submit its recommendations in a report to the

 1 legislature, with copies to be submitted to the governor and
 
 2 chief justice.  At the next regular legislative session, the
 
 3 amounts recommended by the commission shall be submitted by the
 
 4 chief justice as part of the judiciary's proposed budget pursuant
 
 5 to the budgetary procedures specified in chapter 37 and section
 
 6 601-2(c).  Salary amounts in the budget as enacted shall take
 
 7 precedence over any inconsistent statutes.]
 
 8      (d)  Not later than the fortieth legislative day of the 2003
 
 9 regular legislative session and every eight years thereafter, the
 
10 commission shall submit to the legislature and the governor
 
11 recommendations for the salaries for members of the justices and
 
12 judges of all state courts and appointed judiciary administrative
 
13 officers, and then dissolve.  The recommended salaries submitted
 
14 shall become effective as provided in the recommendation unless:
 
15      (1)  The legislature disapproves the recommendation by
 
16           adoption of a concurrent resolution prior to
 
17           adjournment sine die of the legislative session in
 
18           which the recommendation is submitted; or 
 
19      (2)  The governor disapproves the recommendation by a
 
20           message of disapproval transmitted to the legislature
 
21           prior to such adjournment."
 
22      SECTION 2.  Statutory material to be repealed is bracketed.

 1      SECTION 3.  This Act shall take effect upon its approval.
