                   A  BILL  FOR  AN  ACT

RELATING TO SEAT BELTS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 291-11.6, Hawaii Revised Statutes, is
 
 2 amended by amending subsection (a) to read as follows:
 
 3      "(a)  Except as otherwise provided by law, no person:
 
 4      (1)  Shall operate a motor vehicle upon any public highway
 
 5           unless the person is restrained by a seat belt assembly
 
 6           and any passengers in the front seat of the motor
 
 7           vehicle are restrained by a seat belt assembly, if
 
 8           between the ages of four and fifteen, or are restrained
 
 9           pursuant to section 291-11.5, if under the age of four;
 
10      (2)  [If fifteen years of age or more shall] Shall be a
 
11           passenger in the front seat of a motor vehicle being
 
12           operated upon any public highway, if fifteen years of
 
13           age or more, unless [such] the person is restrained by
 
14           a seat belt assembly[.]; and
 
15      (3)  Shall be a passenger in the back seat of a motor
 
16           vehicle being operated upon any public highway, if
 
17           between the ages of four and thirteen, unless the
 
18           person is restrained in a seat belt assembly.
 
19      As used in this section "seat belt assembly" means the seat

 1 belt assembly required to be in the motor vehicle under any
 
 2 federal motor vehicle safety standard issued pursuant to Public
 
 3 Law 89-563, the federal National Traffic and Motor Vehicle Safety
 
 4 Act of 1966, as amended, unless original replacement seat belt
 
 5 assemblies are not readily available.  If replacement assemblies
 
 6 are not readily available, seat belts of federally approved
 
 7 materials with similar protective characteristics may be used.
 
 8 Such replacement seat belt assemblies shall be permanently marked
 
 9 by the belt manufacturer, indicating compliance with all
 
10 applicable federal standards."
 
11      SECTION 2.  This Act does not affect rights and duties that
 
12 matured, penalties that were incurred, and proceedings that were
 
13 begun, before its effective date.
 
14      SECTION 3.  Statutory material to be repealed is bracketed.
 
15 New statutory material is underscored.
 
16      SECTION 4.  This Act shall take effect upon its approval.
