                   A  BILL  FOR  AN  ACT

RELATING TO THE LAND USE COMMISSION.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 205-1, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "§205-1 Establishment of the commission.  There shall be a
 
 4 state land use commission, hereinafter called the commission.
 
 5 The commission shall consist of nine members who shall hold no
 
 6 other public office and shall be appointed in the manner and
 
 7 serve for the term set forth in section 26-34.  One member shall
 
 8 be appointed from each of the counties and the remainder shall be
 
 9 appointed at large[.]; one of whom shall be a non-voting member
 
10 representing the office of Hawaiian affairs.  The commission
 
11 shall elect its chairperson from one of its voting members.  The
 
12 members shall receive no compensation for their services on the
 
13 commission, but shall be reimbursed for actual expenses incurred
 
14 in the performance of their duties.  Six affirmative votes shall
 
15 be necessary for any boundary amendment.
 
16      The commission shall be a part of the department of
 
17 business, economic development, and tourism for administration
 
18 purposes, as provided for in section 26-35.

 1      The commission may engage employees necessary to perform its
 
 2 duties, including administrative personnel and an executive
 
 3 officer.  The executive officer shall be appointed by the voting
 
 4 members of the commission and the executive officer's position
 
 5 shall be exempt from civil service.  Departments of the state
 
 6 government shall make available to the commission such data,
 
 7 facilities, and personnel as are necessary for it to perform its
 
 8 duties.  The commission may receive and utilize gifts and any
 
 9 funds from the federal or other governmental agencies.  It shall
 
10 adopt rules guiding its conduct, maintain a record of its
 
11 activities and accomplishments, and make recommendations to the
 
12 governor and to the legislature through the governor."
 
13      SECTION 2.  Statutory material to be repealed is bracketed.
 
14 New statutory material is underscored.
 
15      SECTION 3.  This Act shall take effect upon its approval.
