                   A  BILL  FOR  AN  ACT

RELATING TO CONDOMINIUM GOVERNANCE.
 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 514A, Hawaii Revised Statutes, is
 
 2 amended by adding a new section to be appropriately designated
 
 3 and to read as follows:
 
 4      "§514A-    Term limitations for officers.  No officer of the
 
 5 board of directors shall serve in the same office for more than
 
 6 six consecutive years.  A break in service of less than the
 
 7 length of the normal term of office shall cause any years served
 
 8 during all or part of any term before and after the break to be
 
 9 considered consecutive years of service for the purposes of this
 
10 section.  After a break in service of one normal term of office
 
11 or more, a person may serve again in the same office, subject to
 
12 the six-year term limitation provided for in this section."
 
13      SECTION 2.  New statutory material is underscored.
 
14      SECTION 3.  This Act shall take effect upon its approval;
 
15 provided that this Act shall not apply to officers who have held
 
16 a position for more than six years at the time of the effective
 
17 date of this Act until the next regularly scheduled annual
 
18 meeting of the officer's association of apartment owners.
