                   A  BILL  FOR  AN  ACT

PROPOSING AN AMENDMENT TO ARTICLE X, SECTION 2, OF THE HAWAII
   CONSTITUTION, TO ALLOW THE STUDENT MEMBER OF THE BOARD OF
   EDUCATION TO VOTE.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The purpose of this Act is to propose an
 
 2 amendment to article X, section 2, of the Constitution of the
 
 3 State of Hawaii to allow the student member of the board of
 
 4 education to vote.
 
 5      SECTION 2.  Article X, section 2, of the Constitution of the
 
 6 State of Hawaii is amended to read as follows:
 
 7                        "BOARD OF EDUCATION
 
 8      Section 2.  There shall be a board of education composed of
 
 9 members who shall be elected in a nonpartisan manner by qualified
 
10 voters, as provided by law, from two at-large school board
 
11 districts.  The first school board district shall be comprised of
 
12 the island of Oahu and all other islands not specifically
 
13 enumerated.  The second school board district shall be comprised
 
14 of the islands of Hawaii, Maui, Lanai, Molokai, Kahoolawe, Kauai
 
15 and Niihau.  Each at-large school board district shall be divided
 
16 into departmental school districts, as may be provided by law.
 
17 There shall be at least one member residing in each departmental
 
18 school district.  The Hawaii State Student Council shall select a

 1 public high school student to serve as a [nonvoting] voting
 
 2 member on the board of education[.]; provided that the student
 
 3 member shall not vote on any issue directly pertaining to either
 
 4 fiscal or personnel matters."
 
 5      SECTION 3.  The question to be printed on the ballot shall
 
 6 be as follows:
 
 7      "Shall the student member of the board of education be
 
 8      allowed to vote on all matters except on issues directly
 
 9      pertaining to either fiscal or personnel matters?"
 
10      SECTION 4.  Constitutional material to be repealed is
 
11 bracketed.  New constitutional material is underscored.
 
12      SECTION 5.  This amendment shall take effect upon compliance
 
13 with article XVII, section 3, of the Constitution of the State of
 
14 Hawaii.
