                   A  BILL  FOR  AN  ACT

RELATING TO SCHOOL BUSES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 302A-407, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "[[]§302A-407[]]  School bus contracts.(a)  Any other law
 
 4 to the contrary notwithstanding, school bus contracts between the
 
 5 State and a private contractor may be extended for two years by
 
 6 mutual agreement; provided that the parties may agree to extend
 
 7 the contract for an additional two years thereafter.  The
 
 8 compensation due to the contractor by the State for each extended
 
 9 year may be increased by an amount not to exceed five per cent of
 
10 the previous year's compensation.  In addition, the compensation
 
11 due to the contractor by the State for any original or extended
 
12 contract year may be increased by a reasonable amount for
 
13 unanticipated inflationary increases in the cost of fuel.  If the
 
14 original contract between the State and a private contractor
 
15 already includes an option to extend the contract period, this
 
16 subsection shall apply after the contract option is exercised.
 
17      (b)  In the renegotiation for the extension of any contract,
 
18 the contractor shall be notified at least three months in advance
 
19 to prepare data and facts relating to fuel cost for the

 1 justification of an increase in the amount for the new contract
 
 2 period.
 
 3      (c)  If a school is temporarily closed due to an unexpected
 
 4 disruption necessitating the closing of the school, the
 
 5 contractor and the State may enter into renegotiation for
 
 6 payments of fixed costs.
 
 7      (d)  The contract between the State and the contractor shall
 
 8 include an age limit for the school bus vehicles that may be
 
 9 used.  The serviceability of a vehicle shall be determined by
 
10 chapter 286.
 
11      (e)  The contract between the State and the contractor shall
 
12 include a provision to provide school bus drivers with the
 
13 appropriate supplies for blood-borne pathogen countermeasures.
 
14      [(e)](f)  The contract between the State and the contractor
 
15 shall include a provision requiring the contractor to equip the
 
16 contractor's vehicles with the signs and visual signals described
 
17 in section 291C-95(d) and (g).  The contract shall also include
 
18 other provisions as may be deemed necessary by the State for the
 
19 safety of school bus passengers and shall include provisions
 
20 requiring periodic refurbishment of school buses over ten years
 
21 old."
 
22      SECTION 2.  Statutory material to be repealed is bracketed.
 
23 New statutory material is underscored.
