Compulsory Education Law


DESCRIPTION:
Requires the DOE to adopt rules to define what it means for a
student to "attend either a public or private school", with
respect to students who attend private sectarian and nonsectarian
schools, for the purposes of determining the student's compliance

                   A  BILL  FOR  AN  ACT

RELATING TO EDUCATION.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 302A, Hawaii Revised Statutes, is
 
 2 amended by adding a new section to subpart C of part IV to be
 
 3 appropriately designated and to read as follows:
 
 4      "§302A-     Attend either a public or private school;
 
 5 definition.  (a)  For the purposes of interpreting the compulsory
 
 6 attendance provisions of section 302A-1132(a), the department
 
 7 shall define by rule what it means for a student to "attend
 
 8 either a public or private school".
 
 9      (b)  The rules shall:
 
10      (1)  Require sectarian private schools to be licensed,
 
11           supervised, certified, and otherwise regulated by the
 
12           ecclesiastical authority for that religion or sect, by
 
13           a nationally recognized accrediting agency recognized
 
14           by the ecclesiastical authority for that religion or
 
15           sect, by the Hawaii Association of Independent Schools,
 
16           or by a nationally recognized accrediting agency
 
17           recognized by the United States Secretary of Education;
 
18           and

 1      (2)  Require nonsectarian private schools to be licensed,
 
 2           supervised, certified, or otherwise regulated by the
 
 3           Hawaii Association of Independent Schools or by a
 
 4           nationally recognized accrediting agency recognized by
 
 5           the United States Secretary of Education.
 
 6      (c)  The interpretation, application, and implementation of
 
 7 this section shall be limited solely to determining whether or
 
 8 not a student attends either a public or private school for the
 
 9 purposes of determining compliance with the compulsory attendance
 
10 provisions of section 302A-1132(a).  It is not the intent of this
 
11 section to authorize the department of education to license,
 
12 supervise, certify, and otherwise regulate private schools, or to
 
13 perform any regulatory functions currently being performed by the
 
14 department of commerce and consumer affairs."
 
15      SECTION 2.  New statutory material is underscored.
 
16      SECTION 3.  This Act shall take effect upon its approval.
