                   A  BILL  FOR  AN  ACT

RELATING TO THE UNIVERSITY OF HAWAII.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 304-3, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "§304-3 Regents; appointment; tenure; qualifications;
 
 4 meetings.  (a)  The affairs of the university shall be under the
 
 5 general management and control of the board of regents consisting
 
 6 of three ex officio members and twelve appointive members.  The
 
 7 three ex officio members shall be the lieutenant governor, the
 
 8 president of the University of Hawaii alumni association, and a
 
 9 member of the board of education selected by the board of
 
10 education.  The twelve appointive members [who] shall be
 
11 appointed by the governor, by and with the consent of the senate,
 
12 and may be removed by the governor.  No more than six of the
 
13 appointive members shall be members of the same political party
 
14 and at least part of the membership of the board shall represent
 
15 geographic subdivisions of the State.  One member shall be a
 
16 University of Hawaii student at the time of the initial
 
17 appointment.  The student member may be reappointed for one
 
18 additional term even though the member may no longer be a student
 
19 at the time of reappointment.  The term of each appointive member

 1 shall be for [four] eight years; provided that the term of the
 
 2 student member shall be for two years.  Appointive members, other
 
 3 than the student member, may be reappointed for one additional
 
 4 term; provided that no appointive member shall serve for more
 
 5 than a total of sixteen years, inclusive of service prior to the
 
 6 effective date of this Act.
 
 7      (b)  Vacancies on the board of regents shall be filled on an
 
 8 interim basis by a majority vote of a quorum of the remaining
 
 9 members of the board of regents, terminating upon the governor's
 
10 appointment, subject to the advice and consent of the senate, of
 
11 a successor to the remaining term of the vacating member.
 
12      The five regents whose terms expire on June 1999, other than
 
13 the student member, during their final meeting prior to the
 
14 expiration date, shall use random drawings to determine which
 
15 three among them shall serve for four more years and which two
 
16 among them shall serve for six more years.  Thereafter, all
 
17 appointments other than the appointment of the student member,
 
18 shall be for eight years.
 
19      (c)  Except as otherwise provided by statute, state officers
 
20 shall be eligible to appointment and membership.  Every member
 
21 may serve beyond the expiration date of the member's term of
 
22 appointment until the member's successor has been appointed and
 
23 has qualified[.]; provided that no member shall serve longer than

 1 sixteen years.  The board [shall], at its first meeting after
 
 2 June 30, shall elect a chairperson and vice-chairperson, who
 
 3 shall serve until adjournment of its first meeting after June 30
 
 4 of the next year or thereafter until their successors are
 
 5 appointed and have qualified and whose election shall be
 
 6 immediately certified by the board to the chief election officer.
 
 7 The board shall appoint a secretary, who shall not be a member of
 
 8 the board.  The president of the university shall act as
 
 9 executive officer of the board.  The board shall meet not less
 
10 often than ten times annually, and may from time to time meet in
 
11 each of the counties of Hawaii, Maui, and Kauai.
 
12      The appointive members of the board shall [serve without pay
 
13 but] receive an annual stipend of $25,000, or less in the
 
14 discretion of the board, and shall be entitled to their traveling
 
15 expenses within the State when attending meetings of the board or
 
16 when actually engaged in business relating to the work of the
 
17 board.  Regents shall not be considered employees of the State,
 
18 notwithstanding their receipt of stipends and reimbursement of
 
19 expenses.
 
20      (d)  In the selection of the appointive members, the
 
21 governor shall consult an advisory committee composed of the
 
22 following eleven members:
 
23      (1)  The speaker of the house of representatives;

 1      (2)  The president of the senate;
 
 2      (3)  The chair of the board of regents;
 
 3      (4)  The president of the University of Hawaii; and
 
 4      (5)  The president of the organization serving as the
 
 5           exclusive representative of the faculty of the
 
 6           University of Hawaii.
 
 7 Members of the advisory committee other than those serving ex
 
 8 officio shall serve four-year terms.  The advisory committee
 
 9 shall be convened by the chairperson of the board of regents from
 
10 time to time and shall prepare for the governor's consideration,
 
11 in advance of vacancies, a list of proposed nominees to the board
 
12 of regents numbering not less than the number of expected
 
13 vacancies plus two, with annotations as to the qualifications of
 
14 each nominee."
 
15      SECTION 2.  Section 26-11, Hawaii Revised Statutes, is
 
16 repealed.
 
17      ["§26-11  University of Hawaii.(a)  The University of
 
18 Hawaii shall be headed by an executive board to be known as the
 
19 board of regents.
 
20      The board shall consist of twelve members.  No more than six
 
21 of the members shall be members of the same political party and
 
22 at least part of the membership of the board shall represent
 
23 geographic subdivisions of the State.  At least one member shall

 1 be a University of Hawaii student at the time of the initial
 
 2 appointment.  This member may be reappointed for one additional
 
 3 term even though the member may no longer be a student at the
 
 4 time of reappointment.
 
 5      The board shall have power, in accordance with the
 
 6 Constitution of the State and with law, to formulate policy, and
 
 7 to exercise control over the university through its executive
 
 8 officer, the president of the university.  The board shall have
 
 9 exclusive jurisdiction over the internal organization and
 
10 management of the university.
 
11      (b)  The board of regents shall appoint and may remove an
 
12 executive officer to be known as the president of the University
 
13 of Hawaii.
 
14      The University of Hawaii as heretofore constituted as a body
 
15 corporate is continued as the University of Hawaii established by
 
16 this chapter."]
 
17      SECTION 3.  Statutory material to be repealed is bracketed.
 
18 New statutory material is underscored.
 
19      SECTION 4.  This Act shall take effect upon its approval.
